The Plaintiff requests an extension to the temporary restraining order. The Plaintiff also asks us to extend the preliminary-injunction hearing to "a date and time following February 12, 2024." Motion at 3. Under Rule 65(b)(2) of the Federal Rules of Civil Procedure, a temporary restraining order "expires at the time after entry -- not to exceed 14 days -- that the court sets, unless before that time the court, for good cause, extends it for a like period or the adverse party consents to a longer extension." The Plaintiff informs us that third-party financial institutions "are still processing Plaintiff's request for information relating to the Defendants and will not be in a position to provide such information prior to the presently scheduled hearing on Plaintiff's pending motion for preliminary injunctive relief. Here, because Plaintiff will not be in a position to restrain all of the Defendants' accounts prior to the preliminary injunction hearing currently set forth in the TRO, good cause exists for an extension of the TRO." Motion at 2-3. We agree -- but this will be our LAST extension of the TRO. We therefore GRANT the Motion as follows: 1. The temporary restraining order shall remain in effect until February 23, 2024. 2. The preliminary-injunction hearing is reset for February 23, 2024, at 10:45 a.m. EST. The Plaintiff requests an extension to the temporary restraining order. The Plaintiff also asks us to extend the preliminary-injunction hearing to "a date and time following January 24, 2024." Motion at 3. Under Rule 65(b)(2) of the Federal Rules of Civil Procedure, a temporary restraining order "expires at the time after entry -- not to exceed 14 days -- that the court sets, unless before that time the court, for good cause, extends it for a like period or the adverse party consents to a longer extension." The Plaintiff informs us that it will take "three to four weeks for all Third-Party Providers to process and restrain the accounts associated with the Defendants identified in Schedule 'A' to the Complaint.
