Gottschall: In contrast with many similar "Schedule A" cases, plaintiff TV Tokyo Corp. does not request to continue freezing defendants' financial accounts to preserve its right to an equitable accounting of profits from sales of infringing merchandise. See Mem. Supp. Mot. Prelim. Inj. 4-5, ECF No. 32. Rather, plaintiff argues, "In the absence of a preliminary injunction, Defendant may attempt to move any assets from any accounts in U.S.-based financial institutions to offshore accounts. Therefore, Defendant's assets should remain frozen for the remainder of the proceedings. The amount of damages to which Plaintiff is entitled as set forth in the Amended Complaint most likely exceeds any amount contained in any of the Defendant's frozen accounts." id. at 4.The court understands plaintiff to be requesting an asset freeze to protect its ability to collect any judgment entered in this case. Supreme Court precedent forbids such relief. See Grupo Mexicano de Desarrollo S.A. v. All. Bond Fund, Inc., 527 U.S. 308, 319-30 (1999). Plaintiff's motion 31 for a preliminary injunction is therefore denied without prejudice to the extent it seeks to continue an asset freeze. The motion 31 is also denied insofar as it seeks leave under Fed. R. Civ. P. 4(f)(3) to serve the summons and complaint by electronic means because plaintiff makes no argument in support of authorizing electronic service in its accompanying memorandum 32. All other relief requested in plaintiff's motion 31 for preliminary injunction is granted.No request for a hearing has been received by the deadline, so the preliminary injunction hearing tentatively set for 8/14/2024 is stricken. If plaintiff does not renew its request to impose an asset freeze by 10:30 a.m. on 8/14/2024, a preliminary injunction consistent with the court's rulings herein will be entered at that time.
