(the "Amicus Parties") filed a motion for leave to file an amicus curiae brief regarding defendants' omnibus motion to dismiss instanter. Defendants Gegecompany, Luckyshops, and Noforget oppose this motion. In deciding whether to grant a motion for leave to file an amicus brief, the Court considers whether the brief will assist "by presenting ideas, arguments, theories, insights, facts, or data that are not to be found in the parties' briefs." Voices for Choices v. Illinois Bell Tel. Co., 339 F.3d 542, 545 (7th Cir. 2003). Leave is more likely to be granted when "a party is inadequately represented; or in which the would-be amicus has a direct interest in another case that may be materially affected by a decision in this case; or in which the amicus has a unique perspective or specific information that can assist the court beyond what the parties can provide." Id. (internal citation omitted). It is within the Court's discretion to grant an application for amicus curiae. Jones Day v. Blockshopper LLC, No. 08 CV 4572, 2008 WL 4925644, at *6 (N.D. Ill. Nov. 13, 2008) (Darrah, J.) (citing National Organization for Women, Inc. v. Scheidler, et al., 223 F.3d 615, 616 (7th Cir. 2000)). After reviewing the briefs, the Court is not convinced by the arguments presented by the Amicus Parties in support of their motion. First, Plaintiff is not inadequately represented. Second, the Amicus Parties make a conclusory assertion that they have an interest in this case because the Court's ruling on Defendants' motion to dismiss could undermine enforcement of injunctions entered by this Court against offshore e-commerce store operators on Wish.com in at least three cases that the Amicus Parties are individually involved. Even after Defendants raised this issue in their response, the Amicus Parties failed to expand on how a ruling in this case would materially affect their cases. Moreover, the Amicus Parties do not have a unique perspective or specific information that can assist the Court beyond what the parties can provide. To the extent that Plaintiff's brief does not contain a discussion of Defendants' challenge to subject matter jurisdiction, it was Plaintiff's choice. Plaintiff had an opportunity to address Defendants' argument and declined to do so. The Court will not permit the Amicus Parties to brief an issue that Plaintiff chose not to address. Accordingly, the Amicus Parties' motion for leave to file amicus brief 124 is denied. Mailed notice. |
