02/23/2021 | MINUTE entry before the Honorable Joan B. Gottschall: On 2/19/2021, plaintiff filed a status report (No. [41]) and a motion (No. [44]) for entry of default judgment. In the status report, plaintiff represents: "As of the date of this filing, no remaining Defendants have indicated that they plan to participate in this Case." Later that day (2/19/2021), two attorneys filed appearances (Nos. [47] and [48]) for defendants sjyinternational and starthere2011 (together "appearing defendants"), and on 2/22/2021, appearing defendants filed a motion (No. [49]) for leave to answer the complaint. The motion (No. [49]) is granted. Appearing defendants have until and including 3/1/2021 to answer or otherwise respond to the complaint. Plaintiff's motion for entry of default judgment as to the appearing defendants is denied. The non-appearing defendants would ordinarily have an opportunity to be heard at a hearing on the motion for entry of default judgment. However, in accordance with the Tenth Amended General Order No. 20-0012 governing court operations during the COVID-19 pandemic, plaintiff (No. [46]) did not notice its motion for default judgment for a presentment hearing, but plaintiff's counsel indicated counsel are available for a telephonic hearing. Any response to plaintiff's motion for entry of default judgment (No. [44]) is due on or before 3/5/2021. Also, no telephonic hearing on the motion will be held unless one is requested on or before 3/5/2021. A hearing to be held by telephone may be requested by contacting Judge Gottschall's courtroom deputy at (312) 435-5641. If no response is received and no hearing is requested by 3/5/2021, the court will rule promptly on plaintiff's motion for entry of default judgment. Plaintiff's counsel are directed to serve this order electronically upon all non-appearing defendants by the same means authorized in the preliminary injunction (No. [37]). A certificate of service must be filed on or before 2/26/2021. Mailed notice |

In accordance with the order, the preliminary injunction hearing set for 1/6/2021 is stricken and reset to 1/20/2021 at 10 a.m. The hearing will be via teleconference. Throughout the hearing, each speaker will be expected to identify themselves for the record before speaking. Members of the public and media will be able to call in to listen to this hearing. The call-in number is 571-353-2300 and the access code is 212945925. 01/05/2021 | DECLARATION of Justin R. Gaudio regarding memorandum in support of motion[22] |
12/30/2020 | MINUTE entry before the Honorable Joan B. Gottschall: On December 30, 2020, plaintiff filed a motion (No. 21) to extend by 14 days the sealed temporary restraining order (No. 20) entered one week earlier. Plaintiff's lawyer avers certain third parties "typically" take action within a specified timeframe after being served with a temporary restraining order and that those actions had not occurred as of December 30, 2020. See Gaudio Decl. 2, 3, 11, ECF No. 22-1. This leaves a one-week gap in the record until the sealed temporary restraining order expires on January 6, 2021. Ordinarily, a short hearing would be held on plaintiff's motion at which the court would be updated on whether any third parties acted more quickly than is typical. Since plaintiff requests ex parte relief, holding such a hearing by teleconferencing, as required by Eighth Amended General Order No. 20-12, does not appear to be necessary. In lieu of holding a hearing, plaintiff may file a supplemental declaration by no later than noon on January 5, 2021, updating the court on the third parties' responses to the sealed temporary restraining order. If plaintiff's counsel would prefer to appear at a hearing to be held by teleconferencing, the courtroom deputy must be advised by noon on January 5, 2021. Mailed notice |
