No. 68) In particular, this Court ordered that "[e]ach notice of voluntary dismissal must attach as an exhibit an updated list of the remaining, non-settling Defendants." That requirement is no small thing. Plaintiff continues to pepper the docket with notices of dismissal, leaving the Court to wonder how many Defendants remain in the case and who they are. It is Plaintiff's job to inform the Court which Defendants remain in the case. It is not the Court's job to figure it out. Since the Court entered that Order, Plaintiff has filed two notices of voluntary dismissal, and neither one attached the Court-ordered list of the remaining, non-settling Defendants. Plaintiff shall file a list of all remaining Defendants by April 7, 2021. Going forward, a failure to comply may lead to appropriate relief, including dismissal. Mailed notice. |

Presumably "Riom" is an entity. If so, the filing needs to be signed by an attorney. See Fed. R. Civ. P. 11(a). An entity cannot proceed pro se and cannot sign a filing in a corporate name. An attorney purported to file a "limited appearance" for "Riom," but yet did not sign the filing. (Dckt. No. 56) Either Riom has a lawyer, or it doesn't, but if so, the lawyer needs to sign the filing as required by the Federal Rules. Maybe "Riom" is a person. Natural persons, unlike entities, can proceed pro se. See Fed. R. Civ. P. 11(a). But if "Riom" is a person, then presumably "Riom" has a first and last name. Even Oprah, Bono, and Eminem have full names. As things stand, the Court does not know who signed the filing, so it is stricken. Mailed notice. |

On January 19, 2021, this Court directed Plaintiff to "give notice to Defendants as required by Rule 65." (Dckt. No. 32) But Plaintiff did not take care of that obligation until January 28, 2021, meaning nine days later. They did not give notice to the Defendants until the day before the hearing. (And even then, based on the certificate of service, it appears Plaintiff neglected to serve a copy of the minute order setting the preliminary injunction hearing. Dckt. No. 37 They served process, meaning that they served the complaint and the summons, and they served the motion for a preliminary injunction, too. But by all appearances, they apparently did not provide notice of the hearing.) Some or perhaps most of the Defendants are presumably overseas, so they cannot receive notice at the last minute. By failing to act in a timely manner, Plaintiff's counsel was unprepared to proceed with the preliminary injunction hearing today. They did not give adequate notice to Defendants, forcing this Court to reschedule yet again. They also did not give this Court advance notice that they were unprepared to proceed (say, by filing a motion to reschedule the hearing, or contacting the Courtroom Deputy), and thus needlessly occupied this Court's calendar. By the end of the day, January 29, 2021, Plaintiff shall serve a copy of this Order on Defendants and file a certificate of service. Status hearing continued for February 3, 2021 at 10:00 a.m. Members of the public and media will be able to call in to listen to this hearing. It appears to be a draft that plaintiff's counsel uses in many other Schedule A cases, except for information about the individual Plaintiff. The draft posed a number of formatting challenges, and required significant time and attention by the Court. (The indentations, tabs, and paragraph numbering were particularly problematic.) The Court also made a number of substantive changes to the draft temporary restraining order. A redline is attached. Going forward, in any future Schedule A case filed before Judge Seeger, plaintiff's counsel must submit a draft that is free of issues and that incorporates the considerable changes that this Court made in the case at hand. Continuing to use the generic draft that the Court received, and simply plugging in the names of new clients in future Schedule A changes, is not a viable option. A failure to comply with this Order may lead to denial of the motions, and/or may delay any relief from this Court.
