Gottschall: At approximately 4:57 p.m. on 3/28/2022, attorney Sam (Shengmao) Mu sent an email message to plaintiff's counsel and copied this court's proposed order email address. The message stated that defendant Christ-EZ Doe 143 objected to the entry of a default judgment against it on the ground that it had reached a settlement with plaintiff. The email message was received after the court approved entry of the default judgment, and the court was not aware of the message when the default judgment was entered on the docket at approximately 5:14 p.m. Counsel for Christ-EZ Doe 143 is advised that its objection is untimely, as written objections were due [68] by 3/25/2022. Furthermore, Local Rule 5.2(d) prohibits counsel from attempting to file by email (if that is what counsel was trying to do): "Documents to be filed with the court may not be transmitted to the court by Email or FAX. The only means of filing documents with the court electronically is in accordance with LR 5.2(a) and the General Order on Electronic Case Filing or other similar General Order." LR 5.2(d). The proper way to seek to set aside the default judgment is to file an appropriate motion under Rules 59 or 60 of the Federal Rules of Civil Procedure. Unless and until such a motion is filed, the default judgment shall stand. Counsel is also reminded that defendant Christ-EZ Doe 143 must file a notification of affiliates complying with Local Rule 3.2 of this court and Rule 7.1 of the Federal Rules of Civil Procedure upon first appearance.Mailed notice

The dismissal is problematic for two reasons. First, the Seventh Circuit has held that the proper way to drop fewer than all defendants is to amend the complaint. Taylor v. Brown, 787 F.3d 851, 857-58 (7th Cir. 2015) (citing Berthold Types Ltd. v. Adobe Sys. Inc., 242 F.3d 772, 777 (7th Cir. 2001) (other citation omitted)). Second, a voluntary dismissal with leave to reinstate within 270 days makes sense only if, on day 270, the dismissal converts to a dismissal with prejudice, which plaintiff has not requested. Blue Cross & Blue Shield Ass'n v. Am. Express Co., 467 F.3d 634 (7th Cir. 2006); Shapo v. Engle, 463 F.3d 641 (7th Cir. 2006).
