This Court denied the motion for reconsideration because the motion was rather generic, and made sweeping statements about "Defendants" and "stores" when there appeared to be only one Defendant. Plaintiff later clarified that AK001 does, in fact, operate more than one store (even though the draft preliminary injunction order says "store," not "stores"), and clarified that the term "Defendants" includes the individuals and entities that run AK001. Plaintiff also confirmed that all of the screen shots in support of the TRO motion were, in fact, from AK001 only, even though the supporting declaration did not make that point expressly. In light of that new information, the Court views the motion for a preliminary injunction in a different light. The motion for a preliminary injunction (Dckt. No. 30) is granted. Order to follow. 04/29/2021 | MINUTE entry before the Honorable Steven C. Seeger: Status hearing held on April 29, 2021 by telephone. The Court discussed plaintiff's motion for reconsideration (Dckt. No. 40). The Court also raised how it could enter judgment against unidentified individuals and entities who operate the seller identified on amended Schedule A. By May 13, 2021, plaintiff's counsel must show cause why counsel should not be sanctioned for filing an amended complaint, dropping 174 of the 175 defendants, and then refiling a new case before a new judge on behalf of those 174 defendants without disclosing the related case on the civil action cover sheet (and representing that there was no related case). By May 3, 2021, counsel shall file a statement under case no. 21-cv-1051 Bludgeon Riffola Ltd. v. Schedule A before Judge Kendall. The statement shall fully inform Judge Kendall that Plaintiff's counsel dropped the 174 defendants from this Court's case and then filed a new case on her docket on behalf of those 174 defendants. 04/15/2021 | MINUTE entry before the Honorable Steven C. Seeger: Plaintiff's motion for a preliminary injunction (Dckt. No. 30) is hereby denied. On February 23, 2021, Plaintiff filed an amended complaint and dropped the claims against 174 of the 175 original defendants. At that moment, only one defendant (AK001) was left. (Dckt. No. 13). But for whatever reason, Plaintiff then filed a motion for a temporary restraining order that described the conduct of the "defendants," plural. (Dckt. No. 14) The motion for a temporary restraining order approached the case like the amended complaint never happened. The declaration from Eric Gelwicks was similarly generic and over-inclusive, describing the conduct by "defendants" (plural), not the last-remaining defendant. (Dckt. No. 17, at para. 17) The Gelwicks declaration attached screenshots, but it is not obvious to the Court whether those screenshots relate to the last-remaining defendant as opposed to the other 174 original defendants. The motion for preliminary injunction is, once again, generic and over-inclusive, asking for an injunction against "defendants" even though there is only one defendant. If Plaintiff wants an injunction against the last-remaining defendant, Plaintiff needs to make a specific showing that the defendant has done something wrong. Plaintiff has made no effort to demonstrate with specificity that the last-remaining defendant has infringed Plaintiff's trademarks. Allegations against former parties does not advance the ball, because those former parties are no longer here. Motion denied. Mailed notice. |

Seeger: On February 19, 2021, Plaintiff's counsel filed a complaint on behalf of Bludgeon Riffola against 175 defendants on the accompanying Schedule A. (Dckt. No. 2) Four days later, after the assignment of the case, Plaintiff's counsel filed an amended complaint that dropped the claims against 174 of the 175 Defendants. (Dckt. No. 13) On February 24, 2021, Plaintiff's counsel then filed a new lawsuit on behalf of Bludgeon Riffola against 174 defendants, and the case was assigned to Judge Kendall. See Bludgeon Riffola v. Schedule A (21-cv-1051). By April 22, Plaintiff's counsel must file a statement explaining why, exactly, they amended the complaint, dropped 174 defendants, and then filed a new lawsuit against 174 defendants.
