The designation "AUSUKY" is the name of a website or online e-commerce store, utilized by plaintiff as a pseudonym for the actual legal entity that is alleged to be using the online store to violate plaintiff's intellectual property rights. The Court allows plaintiffs to proceed in this manner because plaintiffs allegedly being damaged by such internet stores have no way of ascertaining the legally recognized owners and so would otherwise have no legal mechanism for vindicating their rights. The Court requires plaintiffs to amend their pleadings to reflect the true names of the owners of such stores whenever they are able to do so. Counsel for the defendant designated "AUSUKY," however, has no such need for the use of a pseudonym, as counsel is aware of the client's identity. Because the client is not identified in it, the motion for extension of time [38] is stricken. Defense counsel is ordered to amend his appearance to reflect his client's identity--whether an individual, corporation, or other legally recognized entity--within seven days of the entry of this order. Failure to do so may result in the striking of counsel's appearance. Counsel may renew the motion for extension of time once he has filed an amended appearance. Mailed notice. |
