日期 描述
11/07/2024 MINUTE entry before the Honorable Georgia N Alexakis: The Court has reviewed plaintiff's status report 52. In that report, plaintiff represents that "the only remaining defendant in this matter" has already been the subject of a notice of voluntary dismissal. [49, 50] This case is therefore terminated. In the future, counsel for plaintiff should affirmatively alert the Court when a motion has been mooted out by a change in circumstances and, relatedly, when a large, multi-defendant case such as this one (with 255 defendants) is ripe for termination. The Court cannot be expected to track, on its own, which of 255 defendants may remain subject to ongoing litigation. Civil case terminated.
11/06/2024 STATUS Report by TV Tokyo Corporation
11/06/2024 MINUTE entry before the Honorable Georgia N Alexakis: The Court previously directed plaintiff to file a renewed motion for default judgment by 10/15/24. 46 No such motion has been filed. Nor has plaintiff filed a motion seeking an extension of time to file its renewed motion for default judgment. The Court directs plaintiff to file a renewed motion for default judgment on or before 11/20/24 (and to notice that motion up for presentment before the Court), or to file a status report on that date explaining why additional time is needed. A failure to adhere to this deadline will result in termination of the case.
10/16/2024 MINUTE entry before the Honorable Georgia N Alexakis: Pursuant to the notice of voluntary dismissal, Defendant No. 36 Dengzhoushidazhiruoyushangmaoyouxiangongsi is dismissed without prejudice.

10/08/2024 MINUTE entry before the Honorable Georgia N Alexakis: Motion hearing held on 10/8/24. Defendant was not present. For the reasons stated on the record, Plaintiff's motion for entry of default and default judgment against the defendant identified in the Amended Schedule A 42 is denied. Plaintiff's renewed motion is due by 10/15/24 and should be noticed up for presentment.

09/12/2024 PRELIMINARY INJUNCTION ORDER Signed by the Honorable Georgia N Alexakis on 9/12/2024.
09/12/2024 MINUTE entry before the Honorable Georgia N Alexakis: The Court has reviewed the status report submitted by plaintiff 39 and plaintiff's motion for a preliminary injunction 31. On the grounds set forth in that motion; in keeping with the order entered by the Court previously assigned to this matter 34 ; in light of the proof of service supplied by plaintiff in compliance with that order 35 ; and given that the defendant has not appeared or objected to plaintiff's motion, this Court considers the motion unopposed and grants it. The preliminary injunction directs, among other things, that the Amended Schedule A be unsealed. Plaintiff is ordered to enter in CM/ECF no later than 9/16/24 the defendant named in the Amended Schedule A as a party in this case. Failure to timely comply with this requirement may result in vacating the preliminary injunction. For instructions as to how to add parties to the case docket, see https://www.ilnd.uscourts.gov/Videos.aspx?folder=_cmecf&play=Add_Terminate.mp4. Plaintiff is directed to file any motion for entry of default and for default judgment on or before 10/10/24 and to notice that motion up for presentment before this Court.

08/30/2024 MINUTE entry before the Honorable Georgia N Alexakis:In light of the recent reassignment of this matter to this Court's calendar, the Plaintiff is directed to file a status report by 9/11/24 using the template on the Court's website for reassigned cases.
08/26/2024 SUMMONS Returned Executed by TV Tokyo Corporation as to The Individuals, Corporations, Limited Liability Companies, Partnerships, and Unincorporated Associations Identified on Amended Schedule A Hereto on 8/23/2024, answer due 9/13/2024.
08/23/2024 EXECUTIVE COMMITTEE ORDER: GENERAL ORDER 24-0024: IT APPEARING THAT, the civil cases on the attached list have been selected for reassignment to form the initial calendar of the Honorable Georgia N. Alexakis; therefore IT IS HEREBY ORDERED that the attached list of 293 cases be reassigned to the Honorable Georgia N. Alexakis; and IT IS FURTHER ORDERED that all parties affected by this Order must review the Honorable Georgia N. Alexakis' webpage on the Court's website for the purpose of reviewing instructions regarding scheduling and case management procedures; andIT IS FURTHER ORDERED that any civil case that has been reassigned pursuant to this Order will not be randomly reassigned to create the initial calendar of a new district judge for twelve months from the date of this Order; and IT IS FURTHER ORDERED that the Clerk of Court is directed to add the Honorable Georgia N. Alexakis to the Court's civil case assignment system during the next business day, so that she shall receive a full share of such cases; and IT IS FURTHER ORDERED that the Clerk of Court is directed to add the Honorable Georgia N. Alexakis to the Court's criminal case assignment system twelve (12) months from the date of this order so that Judge Alexakis shall thereafter receive a full share of such cases. Case reassigned to the Honorable Georgia N Alexakis for all further proceedings. Honorable Jeffrey I Cummings no longer assigned to the case. Signed by Honorable Virginia M. Kendall on 8/23/2024.
08/23/2024 CERTIFICATE of Service by Robert Payton Mcmurray on behalf of TV Tokyo Corporation
08/23/2024 MINUTE entry before the Honorable Jeffrey I Cummings: Before the Court is plaintiff's motion for entry of a preliminary injunction 31. In connection with that motion, plaintiff must serve all remaining defendants with the following statement: "The Court has taken the motion for a preliminary injunction under advisement and will consider the motion unopposed if no defendant appears and objects by or before September 3, 2024." If no objections are filed by that date, the Court will consider the motion unopposed. Plaintiff must serve this minute order upon all remaining defendants within one business day of its entry on the docket and must promptly file proof of that service. For the reasons stated in the Court's order entering the TRO, the TRO is extended to and including the date upon which the Court adjudicates the motion for a preliminary injunction. See H-D Mich., LLC v. Hellenic Duty Free Shops S.A., 694 F.3d 827, 843-45 (7th Cir. 2012). Because this extension exceeds the maximum duration for a TRO under Fed.R.Civ.P. 65(b), this extension "becomes in effect a preliminary injunction that is appealable, but the order remains effective." Id. at 844. Mailed notice.

07/31/2024 SEALED TEMPORARY RESTRAINING ORDER Signed by the Honorable Jeffrey I Cummings on 7/31/2024
07/30/2024 MINUTE entry before the Honorable Jeffrey I Cummings: Plaintiff's motion for leave to file excess pages 11 and ex parte motion for a temporary restraining order, including a temporary injunction, a temporary asset restraint, and expedited discovery and electronic service of process 12 are granted as to Amended Schedule A. Plaintiff's submissions establish that, were defendants to learn of these proceedings before the execution of plaintiff's requested preliminary injunctive relief, there is a significant risk that defendants could destroy relevant documentary evidence and hide or transfer assets beyond the reach of the Court. Accordingly, subject to unsealing at an appropriate time, plaintiff may file under seal the documents identified in the motion to seal. The Temporary Restraining Order being entered along with this minute order shall also be placed under seal. In addition, for the purpose of the motions cited above, plaintiff's filings support proceeding on an ex parte basis at this time. Specifically, and as noted above, were defendants to be informed of this proceeding before a TRO could issue, the Court finds that it is likely that their assets and websites would be redirected, thus defeating plaintiff's interests in identifying defendants, stopping defendants' infringing conduct, and obtaining an accounting. In addition, the evidence submitted by plaintiff shows a likelihood of success on the merits (including evidence of active infringement and sales into Illinois), that the harm to plaintiff is irreparable, and that an injunction is in the public interest. An injunction serves the public interest because of the consumer confusion caused by counterfeit goods, and there is no countervailing harm to defendants from an order directing them to stop infringement. Electronic service of process does not violate any treaty and is consistent with due process because it effectively communicates the pendency of this action to defendants. Expedited discovery is warranted to identify defendants and to implement the asset freeze. Plaintiff shall submit their amended proposed temporary restraining order reflecting Amended Schedule A to the Court's proposed order inbox by 7/31/24. Status hearing set for 9/23/24 at 9:00 a.m. (to track the case only, no appearance is required). Mailed notice
