The Rhodes affidavit establishes that equitable relief is appropriate, because plaintiff is irreparably harmed by the loss of exclusivity and a permanent injunction is appropriate to redress that harm. No harm to defendants exists from an injunction ordering them not to infringe plaintiff's copyrights. Statutory damages in the amount of $50,000 per defendant is appropriate to deter infringement that is easy to commit, and after considering the absence of any evidence about lost profits or actual harm. | 08/08/2022 | MINUTE entry before the Honorable Manish S. Shah: Plaintiff's motion for expedited discovery and electronic service of process 8 10 is granted in part. The court notes that plaintiff did not file a motion seeking permission to seal Schedule A, but the court nevertheless allows Schedule A to remain under seal pending service of process, because plaintiff's motion does establish a risk that defendants will evade service if notified about this case before service. Plaintiff has made no showing justifying any discovery of the merits, but plaintiff has shown good cause for early discovery to identify defendants. The court authorizes discovery of third parties limited to information necessary to identify defendants (identity and financial accounts, which can lead to identifying defendants). Electronic service of process does not violate a treaty and is consistent with due process because it is a direct method of providing actual notice to defendants who operate online accounts. The court doubts that 240 defendants are properly joined, and warns plaintiff that it is not likely to allow a case of that size to proceed. The court's order authorizing early discovery and electronic service of process is entered under seal, for the same reasons the court authorizes the sealing of Schedule A. Enter sealed order. |
