11/08/2024 MINUTE entry before the Honorable Jeffrey T. Gilbert: Telephone status hearing held on 11/8/24. Off the record settlement discussions held with counsel. The parties are continuing to discuss settlement though, in the Court's view, the prospects for a negotiated resolution at this juncture are not good. The Court would like to be wrong, however. In any event, the status hearing set for 12/12/24 at 10:00 a.m. will proceed as scheduled and is converted from in-person to telephone. The 12/10/24 status report deadline [73] shall stand. If parties want to shorten the fact discovery period and advance dates for Rule 26(a)(2) disclosures, they should include that in their report as well. If the parties disagree on next steps in discovery, the status report should explain both sides positions in that regard. At Defendants' request, Plaintiff will provide to Defendants today the sales data that Plaintiff has from Amazon that animates, in part, its settlement demand.
