10/31/2024 | MAILED copyright report to Registrar, Washington DC |
10/30/2024 | DEFAULT FINAL JUDGMENT ORDER Signed by the Honorable Joan B. Gottschall on 10/30/2024.Mailed notice |
10/30/2024 | MINUTE entry before the Honorable Joan B. Gottschall: Upon consideration of the accompanying certificates of service (Doc. Nos. 48, 49), Plaintiff's motion 45 for entry of default judgment is reinstated and granted. Enter default judgment. Civil case terminated. Mailed notice |
09/11/2024 | MINUTE entry before the Honorable Joan B. Gottschall: The proposed default judgment order, read literally, prohibits third parties such as Amazon from owning internet stores that could be used for infringing goods, even if without their knowledge. The court will not enter a default judgment that is so extraordinarily overbroad. Plaintiff may resubmit a proposed order, but plaintiff is cautioned to read it and edit out such overbroad language. In particular, in dealing with presumably innocent third parties, plaintiff should use carefully targeted language or submit a brief justifying the language she has proposed. Accordingly, the motion [45] for entry of a default judgment is denied without prejudice. Mailed notice |

Plaintiff does not indicate how long she expects her investigation to take and does not propose a deadline to file her next status report. In the absence of a proposal, the next status report is due in approximately 30 days, on or before 7/29/2024. 05/28/2024 | MINUTE entry before the Honorable Joan B. Gottschall: Plaintiff's motion 30 for leave to serve discovery prior to a Fed. R. Civ. P. 26(f) conference is granted. Plaintiff's motion 30 under Fed. R. Civ. P. 4(f)(3) for leave to serve the summons and complaint by electronic means is denied without prejudice as premature because Plaintiff neither cites nor attempts to distinguish this court's holding in Luxottica Grp. S.p.A. v. Partnerships & Unincorporated Associations Identified on Schedule "A", 391 F. Supp. 3d 816, 82128 (N.D. Ill. 2019), that a plaintiff must demonstrate reasonable diligence in determining an international defendant's mailing address before the court can find that the Hague Convention does not apply and authorize service by electronic means. See Luxottica, 391 F. Supp. 3d at 82224. Plaintiff may renew her motion after third-party providers of services to defendant answer plaintiff's discovery requests, and plaintiff has conducted a reasonably diligent investigation of any mailing addresses disclosed. Enter order consistent with the foregoing rulings. Mailed notice. |
