Those Defendants identified in Plaintiff's motion have failed either to plead or to otherwise appear to defend against this action. Accordingly, default is entered under Rule 55(a) of the Federal Rules of Civil Procedure. Any objections to the motion for entry of default judgment must be filed on or before 11/9/2023. If no objections are filed by that date, the Court will consider the motion unopposed. Plaintiff must serve this minute order forthwith upon all affected Defendants and must file proof of service. Separately, Plaintiff has noted in its motion for default that it expects to file a notice of voluntary dismissal as to the Shenzhen Hekeyuan entity. ("Shenzhen Hekeyuan") has filed, through counsel Edward Chen, a motion 100 under Rule 12(b)(6) of the Federal Rules of Civil Procedure to dismiss Plaintiff's complaint for failure to state a claim. Shenzhen Hekeyuan states that it operates two digital stores that are Defendants in this action: "Surace" (Def. 79) and "Wingle-Direct" (Def. 88) (Shenzhen Hekeyuan did not identify either of these Defendants by number). Shenzhen Hekeyuan has, however, on behalf of Surace and Wingle-Direct, already filed an answer to Plaintiff's complaint. See Dkt. 40 (entered on 5/30/2023). As Rule 12(b) explains, a motion under Rule 12(b)(6) "must be made before pleading if a responsive pleading is allowed." An answer, like the answer Shenzhen Hekeyuan has already filed, is a "responsive pleading" under Rule 7(a). Accordingly, Shenzhen Hekeyuan's motion to dismiss is both late (under the Rules and the time allowed in this case to respond to Plaintiff's complaint (see Dkt. 31)) and superfluous. Accordingly, the motion 100 to dismiss is itself dismissed. A status hearing as to Defendants Surace and Wingle-Direct will be set by separate order. Mailed notice |
