Counsel for Plaintiff and Defendant Nos. 4 (Topdiaos) and 16 (EuTengHao) appeared; counsel for Defendant Nos. 1 (BIRANCO), 2 (DDAI LLC), and 3 (PREBOX) did not appear. Plaintiff reports that it intends to file an amended complaint and renewed motions for electronic service and temporary restraining order and is discussing possible resolution with the Defendants who have appeared. Counsel for Defendant Nos. 4 and 16 states that they: are unrelated to each other; intend to waive service when presented with the proper waiver of service forms; and may move to enforce a purported settlement agreement or request the Court's assistance in resolving the dispute. As discussed on the record, any amended complaint must provide sufficient information about the intellectual property allegedly being infringed and must include specific allegations as to each Defendant that establish sufficient grounds for joinder of all defendants under Fed. R. Civ. P. 20(a)(2). See Estee Lauder Cosmetics, Ltd. v. P'ships and Unincorporated Ass'ns Identified on Schedule "A," 334 F.R.D. 182 (N.D. Ill. 2020); Art Ask Agency v. Individuals, Corps. Ltd. Liab. Cos., P'ships and Unincorporated Ass'ns Identified on Schedule "A," 21-cv-06197, 2021 WL 5493226 (N.D. Ill. Nov. 23, 2021); Bose Corp. v. P'ships and Unincorporated Ass'ns Identified on Schedule "A," 334 F.R.D. 511 (N.D. Ill. 2020). In addition, any renewed motion for electronic service must be based on more than just the location of Defendants. Among other things, it must show due diligence in attempting to obtain information on how to serve the Defendants through other means. Plaintiff's amended complaint is due by 2/29/24. Defendant Nos. 4 and 16 may file a motion to enforce settlement or email the courtroom deputy to request that the claims against them be referred to the magistrate judge to conduct a settlement conference, if agreed to by all affected parties.
