Defendants have failed to appear or respond to the complaint, and failed to appear or otherwise object to entry of default judgment, despite being provided notice and the opportunity to be heard. Default judgment is entered in favor of Plaintiff and against all Defendants listed on Schedule A to the forthcoming Judgment Order, which will be entered separately. Plaintiff is awarded $5,000.00 in statutory damages against each Defendant, for a total of $790,000.00. The Court recognizes this is significantly less than the $100,000.00 per Defendant requested by Plaintiff. However, Plaintiff failed to provide sufficient factual or legal argument (e.g., specific calculations based on the marks and goods at issue for each Defendant) demonstrating that an award of $100,000.00 was appropriate for each Defendant based on that individual Defendants' conduct. The Court therefore awarded statutory damages it deemed appropriate based on the limited information and argument before it. Judgment entered. Civil case terminated.

03/17/2023 MINUTE entry before the Honorable Nancy L. Maldonado: The Court notes that only one defendant appeared and objected to Plaintiff's motion for entry of default and default judgment [84], but that Defendant has subsequently been voluntarily dismissed. No other defendants having appeared or objected, the Court directs the Clerk to enter default against all Defendants. As there have been multiple voluntary dismissals of defendants, including after the motion for default was filed, Plaintiff is directed to file an amended schedule of active defendants on the docket, so that the record is clear what defendants remain at issue. A default judgment prove-up hearing is scheduled for May 4, 2023 at 10:00 a.m. via WebEx video conference. However, based on its review of Plaintiff's memorandum in support of its motion for default judgment, the Court has determined it requires supplemental briefing and materials from Plaintiff prior to the hearing supporting its request for $100,000 in statutory damages per defaulting defendant. This Court makes a reasoned, evidence-based, and individualized assessment of statutory damages for each defaulting defendant based on their particular conduct. See, e.g., Estee Lauder Cosmetics Ltd. v. P'ships and Unincorporated Ass'ns Identified on Schedule A, 334 F.R.D. 182, 186 (N.D. Ill. 2020) ("[A]n online store that shows thousands of reviews for a counterfeit product probably sold much more of that product than an online store with zero reviews for it, and the more prolific seller should be tagged with a larger damages award"). Based on the Court's review of the record, many of the defendants sell different types of products at different price points and at varying volumes (insofar as volume of sales can be inferred from evidence such as store reviews or number of products offered). For example, the infringing products here appear to range from items as low as $20 each to items in excess of $100 each, and the individual defendant's online stores appear to have different inventories and selections of products, suggesting differing scales of operations. Based on this record, an across-the board award of $100,000 per defaulting defendant is excessive and not particularized to any individual defendant's conduct. Therefore, by April 20, 2023, Plaintiff shall file a supplemental memorandum in support of its motion for default judgment that includes an individualized damages assessment on a defendant-by-defendant basis. Specifically, Plaintiff should provide a chart that lists all of the Defendants and the amount of statutory damages sought against each individual Defendant, and which provides a summary for each Defendant of the information supporting their particular statutory damages amount, including the size and scope of the Defendant's operations, the price range and number of the counterfeited products sold, any information regarding the volume of or revenue from sales of counterfeited products, and any other information that supports the sought statutory damages award. The information in the summary should be supported by citations to exhibits submitted with the briefing to avoid the time-consuming effort of this Court searching the record for factual support in prior filings. At the hearing, Plaintiff's counsel should be prepared to address the statutory damages amount sought, and the evidence showing that the award sought is reasonable for each defendant. During the video hearing, the parties should turn off their cameras and mute their microphones until their case is called. All persons granted remote access to proceedings are reminded of the general prohibition against photographing, recording, and rebroadcasting of court proceedings. Violation of these prohibitions may result in court-imposed sanctions, including removal of court-issued media credentials, restricted entry to future hearings, denial of entry to future hearings, or any other sanctions deemed necessary by the Court.

01/09/2023 MINUTE entry before the Honorable Nancy L. Maldonado: The Court has reviewed Plaintiff's Renewed Motion for Entry of a Preliminary Injunction Against Defendant Nos. 31-37 and 163-201 [72]. The motion states that it is identical to the motion filed at Dkt. [40], which Plaintiff states the Court did not rule upon. However, in the Court's minute order on 11/04/2022 [64], the Court granted the motion with the exception of Defendant MMBL Toy Store, because that Defendant had filed a motion to dismiss. [60]. The Court ordered Plaintiff's counsel to submit a revised proposed Order for Preliminary Injunction to the Court's proposed order email (Proposed_Order_Maldonado@ilnd.uscourts.gov) for the Court to review, but no proposed order was received. The Court is in receipt of a proposed preliminary injunction order associated with this renewed motion. However, the Court notes that while the motion and proposed order indicate it covers Defendant Nos. 31-37 and 163-201, several of the Defendants in that range have been dismissed, including MMBL Toy Store [78] and Defendant Nos. 165, 186, and 187 [67] [70]. While the table in the proposed order correctly omits some of those defendants, it still includes No. 167 MMBL Toy Store, and the text of the order refers to the full range of defendants between Nos. 163-201, which is inaccurate. A revised proposed order is thus required. The motion for preliminary injunction [72] is granted, and Plaintiff should submit a revised proposed injunction order that correctly identifies the Defendants that are included in the order.
