03/02/2022 | MINUTE entry before the Honorable Franklin U. Valderrama: Defendant US-Great has moved to vacate the preliminary injunction and to dismiss for lack of personal jurisdiction [25]. In response, Plaintiff moved to stay US-Great's motion and for leave to conduct jurisdictional discovery [27]. Plaintiff also moved to require compliance with N.D. Ill. Local Rule 83.15 [28], as counsel for US-Great, Shengmao Mu lists only a New York address in his appearance form [19]. Local Rule 83.15 requires that "[a]n attorney who does not have an office within this District. may appear before this Court only upon having designated as local counsel a member of the bar of this Court having an office within this District upon whom service of papers may be made." A search has showed that Counsel Mu is a member of the Northern District of Illinois General Bar; however, Local Rule 83.15 does not contain an exception for members of the General Bar. By 3/9/2022, Counsel Mu is directed to file a response to Plaintiff's motion for compliance [28]; in the alternative, Counsel Mu may designate local counsel, which may be a member of his firm who has an office in this District. Additionally, the Court sets the following briefing schedule on Plaintiff's motion to stay defendant's motion and for jurisdictional discovery: Defendant US-Great's response due by 3/23/2022; Plaintiff's reply due by 3/30/2022. Briefing on US-Great's motion to vacate and to dismiss [25] is held in abeyance until further order. Plaintiff is reminded that, pursuant to the Court's Standing Order, all motions except those identified in the Order must indicate in the title and the body whether the motion is opposed or unopposed. Additionally, Defendant Yingyan-apparel has filed an unopposed extension of time to answer or otherwise respond [31]. Defendant Yingyan-apparel's motion [31] is granted. Defendant Yingyan-apparel's deadline to answer or otherwise respond to the complaint is extended to 3/11/2022. Finally, the Court grants Plaintiff's motion for entry of default and default judgment [33] as to the Defendants Identified in the First Amended Schedule A. The Court enters judgment in favor of Plaintiff and against Defendants identified in First Amended Schedule A. Statutory damages are awarded in the amount of $200,000.00 for trademark counterfeiting per each distinct Defaulting Defendant as indicated in the Order. Enter Default Judgment Order. To obtain release of the bond previously posted in this action, Plaintiff's counsel must file a motion for the return of the bond once the preliminary injunction no longer applies to any Defendant.
