04/02/2024 MEMO ENDORSEMENT ON LETTER: ENDORSEMENT: Plaintiffs application to maintain the case under seal for an additional three-month period is denied. [T]he courts will entertain such an application and seal the entire case only in exceptional cases. Bernstein v. Bernstein Litowitz Berger & Grossmann LLP, No. 14 Civ. 6867 (VEC), 2016 WL 1071107, at *16 (S.D.N.Y. Mar. 18, 2016), affd, 814 F.3d 132 (2d Cir. 2016). But this is not such an exceptional case. Id. Plaintiff requests that the Court maintain this case under seal because Plaintiffs Motion for TRO is still pending in the Northern District of Illinois, Eastern Division and has not yet been entered by the assigned judge. Feb. 6, 2024 Sealing Appl. at 1; see also supra at 2 (contending that continued sealing of case is necessary until district court decide[s] [Plaintiffs] motion for a TRO). The docket in the Northern District of Illinois action, however, reflects that Plaintiffs application for a temporary restraining order was granted on March 18, 2024. See Diamond Painting Intl Inc v. The Partnerships & Unincorporated Assns, 23 Civ. 17192 (JFK) (N.D. Ill. Mar. 18, 2024), ECF No. 27 (Order Granting a Temporary Restraining Order). Accordingly, the justification proffered by Plaintiff in this and previous applications for temporarily sealing the case no longer applies, and Plaintiff has not otherwise made a showing of exceptional circumstances to support extending the seal for three more months. Doe v. Juan Gonzales Agency Corp., No. 21 Civ. 00610 (PMH), 2022 WL 3100669, at *1 (S.D.N.Y. Aug. 4, 2022). [B]ecause Plaintiff has proffered no basis for maintaining this dismissed action under seal, the [] Court [must] unseal this now-closed case. Primera Maritime (Hellas) Ltd. v. Brave Bulk Transp. A party's application to seal the proceedings in their entirety. is a request for extraordinary relief. Doe v. Greiner, 662 F. Supp. 2d 355, 359-60 (S.D.N.Y. 2009). [T]he courts will entertain such an application and seal the entire case only in exceptional cases. Bernstein v. Bernstein Litowitz Berger & Grossmann LLP, No. 14 Civ. 6867 (VEC), 2016 WL 1071107, at *16 (S.D.N.Y. Mar. 18, 2016), affd, 814 F.3d 132 (2d Cir. 2016). This is "not such an "exceptional" case." Id. Plaintiff requests that the Court maintain this case under seal post-termination because it was filed under seal at inception. In light of the dismissal of this action, however, the justification that Plaintiff had proffered in its initiating papers for temporarily sealing the case namely, to avoid the substantial and irreparable harm that will be caused by giving Defendant counterfeiters advance warning that they have been sued, Pl.s Sealing Mem. at 4-5 no longer applies.
