12/27/2024 ANNUAL REMINDER: Pursuant to Local Rule 3.2 (Notification of Affiliates), any nongovernmental party, other than an individual or sole proprietorship, must file a statement identifying all its affiliates known to the party after diligent review or, if the party has identified no affiliates, then a statement reflecting that fact must be filed. An affiliate is defined as follows: any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party. The statement is to be electronically filed as a PDF in conjunction with entering the affiliates in CM/ECF as prompted. As a reminder to counsel, parties must supplement their statements of affiliates within thirty (30) days of any change in the information previously reported. This minute order is being issued to all counsel of record to remind counsel of their obligation to provide updated information as to additional affiliates if such updating is necessary. 12/12/2024 MINUTE entry before the Honorable April M. Perry: Plaintiff's Motion to Seal 12, Motion for Electronic Service of Process 14, and Motion for Expedited Discovery 13 are granted. Plaintiff's Motion for Temporary Restraining Order 15 is denied without prejudice. In order to be entitled to equitable relief like a TRO, the Plaintiff must show (among other things) that there is ongoing or impending harm. Swanigan v. City of Chicago, 881 F.3d 577, 583 n. 2 (7th Cir. 2018). "Past injury alone is insufficient." Simic v. City of Chicago, 851 F.3d 734, 738 (7th Cir. 2017). The Plaintiff's has submitted as exhibits in support of its argument of infringement in this case screenshots of various defendants selling various products. The screenshots are from February and September 2022, November and December 2023, and April, May, August and September 2024, with the most recent screenshot for any infringement being September 24, 2024. For at least one defendant, the only evidence is from December 2023. This is not sufficient evidence of ongoing harm. Should Plaintiff re-file for a TRO, it is encouraged to submit live weblinks along with screenshots of the alleged infringement with notations (either cover pages of a table of contents) within the exhibit noting the defendant to which each screenshot applies so the Court can evaluate both personal jurisdiction and the likelihood of irreparable injury. The Court also requests that by 12/30/2024, Plaintiff submit a memorandum explaining why joinder is appropriate for the 16 Defendants in this case. See, e.g., Estee Lauder Cosmetics Ltd. v. Schedule A, 334 F.R.D. 182 (N.D. Ill. 2020). The Court is especially interested in an explanation of why 13 Defendants were added to the case post-filing 9.
