Jenkins: The Court is not prepared to grant the request for a temporary restraining order based on the information contained in the template Plaintiff filed [see 22], so the motion for a TRO 17 is denied without prejudice to renewal. All the dates listed in the 'last date collected column' are at least one year old, and most of the dated range from late 2022 to mid-to-late 2023. Not a single date is from the year 2024. This does not persuade the Court that without prompt relief, Plaintiff will suffer "immediate and irreparable injury" as required under FRCP 65(b)(1)(A) for a TRO to issue. Plaintiff is free to file an amended complaint which narrows the number of Defendants listed in Schedule A, but in no event will the Court grant a TRO without a very recent showing of alleged infringement which would support immediate relief. Any renewed motion for a TRO must be accompanied by a revised Schedule A template. The motions for excess pages 16 is granted. Plaintiff must take some action to move the case forward by December 12, 2024, otherwise the Court will consider dismissal without prejudice. Mailed notice. |

Please note that the table's requirements were revised on October 10, 2024. As explained there, Plaintiff must complete and file the template linked on that page before the Court will consider granting any motion for preliminary injunctive relief. The submission must also provide a listing of all prior Schedule A cases filed in any court in the United States in which Plaintiff was a plaintiff, and a listing of any of the defendants included in the Schedule A in this case that Plaintiff has previously named as a defendant in any prior complaint or Schedule A case. 11/21/2024 | MINUTE entry before the Honorable Lindsay C. Jenkins: Plaintiff's motion 2 is denied in part. The motion is denied with respect to the request to temporarily proceed under a pseudonym. No-name litigation is disfavored in general, and the Seventh Circuit has repeatedly voiced disfavor of parties proceeding anonymously, as anonymous litigation runs contrary to the rights of the public to have open judicial proceedings. The Court is not convinced that the circumstances described in Plaintiff's filing are truly exceptional; hundreds of other "Schedule A" cases proceed without anonymity and the Court cannot see why this case is any different. By November 26, 2024, Plaintiff may refile its complaint in its own name without the use of a pseudonym, and it may renew its motion to seal certain of its filings. Failure to do so by this deadline will result in dismissal without prejudice. Mailed notice. |
