Before the Court is Plaintiff's Motion for Reconsideration 138 regarding this Court's previous order partially granting Plaintiff's Motion to Unseal. The Court maintained a few business records under seal but unsealed Defendant's substantive Motion to Dismiss 134. Plaintiff moves for reconsideration pursuant to Fed. R. Civ. P. 54(b), which governs motions to reconsider interlocutory orders. This Rule provides that any order that does not resolve all claims as to all parties "may be revised at any time before the entry of a judgment adjudicating all the claims and all the parties' rights and liabilities." Fed. R. Civ. P. 54(b). While motions to reconsider are permitted, they are disfavored. Such motions "serve a limited function: to correct manifest errors of law or fact or to present newly discovered evidence." Patrick v. City of Chicago, 103 F.Supp.3d 907, 911 (N.D. Ill. 2015) (quoting Conditioned Ocular Enhancement, Inc. v. Bonaventura, 458 F.Supp.2d 704, 707 (N.D. Ill. 2006); see also Caisse Nationale de Credit Agricole v. CBI Indus., Inc., 90 F.3d 1264, 1269 (7th Cir. 1996)). A manifest error of law or fact occurs when a district court "has patently misunderstood a party, or has made a decision outside the adversarial issues presented to the Court by the parties, or has made an error not of reasoning but of apprehension." Bank of Waunakee v. Rochester Cheese Sales, Inc., 906 F.2d 1185, 1191 (7th Cir.1990). A party asserting such an error bears a heavy burden, and motions for reconsideration "are not at the disposal of parties who want to 'rehash' old arguments." Patrick, 103 F.Supp. at 912 (citing Zurich Capital Mkts., Inc. v. Coglianese, 383 F.Supp.2d 1041, 1045 (N.D. Ill. 2005). Plaintiff claims the few pages that the Court kept under seal do not contain confidential business information and so the Court's Order was improper. Motions to Seal are discretionary and the Court reasoned that, while materials filed in litigation are to be made public to the maximum extent, documents indicating the E-Bay account names, email addresses, and user IDs for the accounts "tinaforyou" and "homesale e store" should remain sealed as they contained confidential business information. The Court largely granted Plaintiff's Motion to Unseal but wanted to maintain respect for any personal information associated with Defendants' E-Bay accounts. Because the Court did not make a manifest error of law or fact in reaching this conclusion, Plaintiff's Motion for Reconsideration 138 is denied.
