Because Plaintiff's motion is over the 500 MB size limit, the Court cannot create a combined PDF (i.e., one document with the motion and all of the exhibits) and must view each document individually. This is time-consuming and an inefficient use of the Court's time. Therefore, by no later than Wednesday, October 2, 2024, Plaintiff will submit to the Undersigned's e-file inbox (goodman@flsd.uscourts.gov) a single PDF attachment which includes the motion [ECF No. 56] and all of the attached exhibits in sequential order [ECF Nos. 56-1--56-24]. On July 5, 2024, Plaintiff filed proof of service alleging service on Defendants Individuals, Corporations, Limited Liability Companies, Partnerships, and Unincorporated Associations Identified on Schedule A on the same day. (DE 29). To date, the following Defendants identified on Schedule A (DE 12-1) have failed to appear or file a responsive pleading to the Complaint: DOE No. 1 to 4, 6, 7, 9 to 12, 14 to 77, 79 to 94, 96 to 108, 117, 118, 120, 123, 124, 127, 128, and 130 to 132 (collectively, "Remaining Defendants"). The Federal Rules of Civil Procedure provide that the Clerk must enter default against a defendant who has failed to plead or otherwise defend. See Fed. R. Civ. P. 55. The motion must reference specific legal authority establishing Plaintiff's entitlement to the relief sought and demonstrating that service was proper. 05/13/2024 PAPERLESS ORDER DISMISSING AND CLOSING CASE. THIS MATTER is before the Court sua sponte. On May 9, 2024, Plaintiff, GOORIN BROS., INC., filed this action against "the individuals, corporations, limited liability companies, partnerships, and unincorporated associations and foreign entities identified on Schedule A." (DE 1.) However, Plaintiff has failed to file any document identifying by name or with any specificity any Defendants in this action beyond two sentences in the Complaint describing Defendants as "individuals and business entities who, upon information and belief, reside mainly in the People's Republic of China or other foreign jurisdictions" and "are merchants on online e-commerce platforms." (DE 1 at 9.) The Court notes that Plaintiff includes two screenshots of allegedly counterfeit products that appear to include business names, but such indirect references to Defendants do not suffice. "A lawsuit is a public event." In re: Chiquita Brands Int'l, Inc., 965 F.3d 1238, 1242 (11th Cir. 2020). As such, the Federal Rules of Civil Procedure require that "[e]very pleading. must name all the parties." Fed. R. Civ. P. 10(a). Here, Plaintiff has failed to provide the Court with any information to ascertain the identities of Defendants. Accordingly, it is ORDERED AND ADJUDGED that this case is DISMISSED WITHOUT PREJUDICE.
