Jenkins:The Court is not prepared to grant the request for a temporary restraining order based on the information contained in the template Plaintiff filed [see [20]], so the motion for a TRO [17] is denied without prejudice to renewal. The most recent date in the filing is from October 2024 (though just a few dates are this recent). In short, the information provided does not persuade the Court that without prompt relief, Plaintiff will suffer "immediate and irreparable injury" as required under FRCP 65(b)(1)(A) for a TRO to issue. Plaintiff is free to file an amended template or amended complaint which narrows the number of Defendants listed in Schedule A, but the Court will not grant a TRO without a very recent showing of alleged infringement which would support immediate relief. Any renewed motion for a TRO must be accompanied by a revised Schedule A template. Plaintiff must take some action to move the case forward by February 3, 2025, otherwise the Court will consider dismissal without prejudice. The motion to seal [3] is granted for now.
