Hunt: Upon Plaintiff's filing of an amended Schedule A 16, the Court has reviewed Plaintiff's ex parte motion for entry of a temporary restraining order, including a temporary asset restraint, expedited discovery, and service of process by email 10 and Plaintiff's amended declaration and exhibits 17. According to the Complaint 2, Plaintiff alleges that Defendants are actively infringing and selling products in Illinois. However, Plaintiff's written submissions do not include any specific evidence to demonstrate minimum contacts with this forum. Merely establishing an online store where infringing products are offered for sale is typically not sufficient to establish both "a willingness to ship goods to Illinois and. the capacity to do so." See NBA Prop. Inc. et al. v. Hanwjh, 46 F.4th 614, 624 (7th Cir. 2022). Accordingly, by 7/12/24, Plaintiff must file supplemental documents supporting a finding of personal jurisdiction over each defendant. Plaintiff's TRO motion 10 remains under advisement. Plaintiff must further comply with all case management procedures and submit a proposed TRO order to the Court's proposed order inbox by 7/16/24. Emailed notice. |

Hunt: Before the Court are Plaintiff Beverly Salas' Complaint 2 ; Amended Motion for Entry of a Temporary Restraining Order, Asset Restraining Order, Expedited Discovery Order, and Service of Process by Email 10 and accompanying documents 11 ; Motion to Exceed Page Limitation 12 ; Motion for Leave to Temporarily Seal Documents 13 ; and Notice of Motion 14. As an initial matter, Plaintiff names 33 Defendants in this single case [2-2] and seeks ex parte TRO relief against each of them 10. However, after reviewing the Complaint 2, the Court questions whether plaintiff has established sufficient grounds for joinder of all defendants under Fed. R. Civ. P. 20(a)(2). See Estee Lauder Cosmetics, Ltd. v. P'ships and Unincorporated Ass'ns Identified on Schedule "A," 334 F.R.D. 182 (N.D. Ill. 2020); Art Ask Agency v. Individuals, Corps. Ltd. Liab. Cos., P'ships and Unincorporated Ass'ns Identified on Schedule "A," 21-cv-06197, 2021 WL 5493226 (N.D. Ill. Nov. 23, 2021); Bose Corp. v. P'ships and Unincorporated Ass'ns Identified on Schedule "A," 334 F.R.D. 511 (N.D. Ill. 2020). By 7/22/24, Plaintiff is ordered to file a supplemental memorandum that refers to specific facts alleged in its filings and provides citations to specific screenshots associated with each Schedule A defendant to demonstrate that joinder is proper. Alternatively, by the same deadline, plaintiff may file under seal an amended schedule A with a subset of the defendants and an amended declaration that explains how each of these defendants is properly joined with each other. Any amended declaration must attach labeled exhibits that contain screenshots or other information specific only to the defendants listed on amended Schedule A. In addition, the Court notes that Plaintiff was directed 6 to file unredacted versions of 3 and 4 by 6/28/24, but failed to do so until 7/7/24, and did not seek leave of court for the late filing. Furthermore, Plaintiff filed a notice of presentment 14 on Sunday, 7/7/24 at 11:42PM, setting several motions 10, 12, 13 for hearing on Wednesday, 7/10/24, which is insufficient notice. Counsel is reminded that continued failure to comply with Court orders, policies and procedures may result in matters being stricken and sanctions being imposed. Accordingly, Plaintiff's Motion for Leave to Temporarily Seal Documents 13 is denied as unnecessary as the Court already granted that relief 6 ; the 7/10/24 presentment date 14 is stricken; Plaintiff's Motion to Exceed Page Limitation 12 is granted; and Plaintiff's TRO motion 10 will remain under advisement until the joinder issue is resolved. 06/26/2024 | MINUTE entry before the Honorable LaShonda A. Hunt: Plaintiff's motion for leave to file under seal and proceed under a pseudonym 5 is granted in part and denied in part. Plaintiff's submissions establish that, were Defendants to learn of these proceedings before the execution of a temporary restraining order, there is a significant risk that Defendants could destroy relevant documentary evidence and hide or transfer assets beyond the reach of the Court. Conversely, there are no exceptional circumstances that would justify allowing Plaintiff to conceal its own identity: Plaintiff anticipates filing an ex parte TRO motion, and the identity of the defendant entities will be placed under seal during the pendency of the ex parte proceedings. Given these protections for Plaintiff's legitimate interests, the countervailing strong public interest in knowing who is seeking recourse in the federal courts compels the Court to deny Plaintiff's request to conceal its own identity, even initially. As the Seventh Circuit has explained, "We have repeatedly voiced our disfavor of parties proceeding anonymously, as anonymous litigation runs contrary to the rights of the public to have open judicial proceedings and to know who is using court facilities and procedures funded by public taxes. To proceed anonymously, a party must demonstrate exceptional circumstances that outweigh both the public policy in favor of identified parties and the prejudice to the opposing party that would result from anonymity." Doe v. Village of Deerfield, 819 F.3d 372, 376-77 (7th Cir. 2016). Thus, the request to seal Plaintiff's Complaint 2 (which, unlike the redacted complaint 1, complies with FRCP 10(a) by "nam[ing] all the parties" including Plaintiff) and the exhibits containing Plaintiff's intellectual property registrations [2-1] is denied. Conversely, subject to unsealing at an appropriate time, Plaintiff may file under seal its anticipated TRO motion and accompanying documents. The Clerk's Office is directed, forthwith, to (1) update the docket to reflect that the Plaintiff's name is "Beverly Salas"; and (2) unseal the following filings: 2 [2-1].
