| 07/01/2024 | MINUTE entry before the Honorable Edmond E. Chang: (1.) On review of Amended Schedule A, and the TRO motion, the Plaintiff shall file a supplement to the motion that provides a side-by-side comparison of the screenshot of the allegedly infringing item with the particular infringed design patent (one of the three), and specifically explaining how the non-ornamental features of the online-seller item infringes on the non-ornamental features of the design patent. The supplement is due on 07/15/2024. (2.) On review of the motion [9] to seal, it is not apparent why the Plaintiff believes that the Defendants will destroy evidence or transfer assets. It is one thing to infer in a counterfeit trademark or copyright case that online sellers are knowingly violating trademark or copyright laws, and thus operate with false identities or would otherwise destroy evidence or evade judgments. It is quite another to infer that a utility-patent infringement case involves defendants akin to counterfeiting defendants. The motion [9] to seal is denied without prejudice to filing a more fulsome motion by 07/15/2024. If sealed information is needed to justify the motion, then the Plaintiff may file a supplement to the motion under seal for the time being. (3.) The motion [10] to use extra pages is granted. (4.) The tracking status hearing of 07/12/2024 is reset to 07/26/2024 at 8:30 a.m., but to track the case only (no appearance is required, the case will not be called). Emailed notice |

The Plaintiff shall review the opinion in Estee Lauder Cosmetics Ltd. v. Schedule A, Case No. 19-cv-7878, 2020 WL 433870 (N.D. Ill. Jan. 27, 2020), and file a supplemental memorandum addressing the propriety of joinder by 07/01/2024. In lieu of the supplemental memorandum, by the same deadline, the Plaintiff may file an amended complaint with (a) one defendant or (b) a subset of the defendants along with a memo explaining why joinder of those defendants is proper (part of the memo may be sealed in order to discuss the particular Defendants in detail to justify the propriety of joinder). The notice of motion of 06/20/2024 is vacated.
