01/29/2024 Clerk's NOTICE of Compliance re 9 Order on Motion to Seal: Entire Case Sealed.
01/26/2024 PAPERLESS ORDER granting in part and denying in part 8 Plaintiff's Motion to Seal and for Leave to Submit Evidence Electronically ("Motion"). In the Motion, Plaintiff requests to seal the entire case pending further Court Order. Specifically, Plaintiff wishes to seal the entire case temporarily. It wants to file an unredacted, amended Complaint (containing all information and accurately identifying its true identity) and then move to unseal the case after the Court has ruled on its anticipated motion for a Temporary Restraining Order and after the relief provided for in the Order has been effected and the Defendants have been served. Upon review of Plaintiff's Motion, the record, and applicable law, the Court finds good cause to seal this matter because Plaintiff's interest in protecting confidential information outweighs the common law right of access. See Romero v. Drummond Co., 480 F.3d 1234, 1246 (11th Cir. 2007). Plaintiff may file an amended, unredacted Complaint and shall file move to unseal the case once the events outlined above have occurred. Additionally, Plaintiff requests leave to electronically submit evidence supporting its motion for Temporary Restraining Order. However, the Court does not find good cause to permit Plaintiff to electronically submit evidence or any subsequent filing after the Court grants Plaintiff's motion to seal the case in its entirety. See S.D. Fla. L.R. 5.4(b)(3). Accordingly, it is ORDERED AND ADJUDGED that Plaintiff's Motion is GRANTED IN PART AND DENIED IN PART. The Clerk of Court is directed to SEAL this entire case. If Plaintiff wishes to pursue injunctive relief, then it shall within seven (7) days of this Order file an unredacted, amended version of the Complaint. In addition, within seven (7) days of the Court's ruling on Plaintiff's anticipated motion for Temporary Restraining Order and service on the Defendants, Plaintiff shall file a motion to unseal the case and shall add all Schedule "A" Defendants as Parties through CM-ECF. All of Plaintiff's subsequent filings shall be filed conventionally with the Clerk of Court. Signed by Magistrate Judge Jonathan Goodman on 1/26/2024.

01/23/2024 PAPERLESS ORDER. THIS MATTER is before the Court on Plaintiff's Motion for Leave to Temporarily Proceed Under a Pseudonym (DE 5) ("Motion"). In the Motion, Plaintiff requests "leave to temporarily proceed under a pseudonym until such time as Defendants are on notice of the action." Upon review of the Motion, the record, and applicable law, the Court does not find good cause to permit Plaintiff to proceed under a pseudonym in light of other available alternatives. Accordingly, it is ORDERED AND ADJUDGED that Plaintiff's Motion (DE 5) is DENIED. Signed by Judge Kathleen M. Williams on 1/23/2024. (rm04)
