11/14/2024 | MINUTE entry before the Honorable John J. Tharp, Jr:Upon receipt of the plaintiff's notice of voluntary dismissal pursuant to Fed. R. Civ. 11/12/2024 | NOTICE of Voluntary Dismissal by ZHIYONG Huang Dismissal of Action 附件: 1:Exhibit Schedule A |
11/07/2024 | MINUTE entry before the Honorable John J. Tharp, Jr: The Court has reviewed the plaintiff's two most recent notices of voluntary dismissal 130 131, which purport to dismiss AHABIPERS Deal LLC (defendant no. 111), MSCOCO Hair (defendant no. 16), and Tianshe Hair (defendant no. 23). The Court observes three issues. First, the plaintiff should have, consistent with the Court's prior instruction 103, filed "one consolidated notice" for these contemporaneously dismissed defendants. Second, and more importantly, the "defendant numbers" are once again incorrect. AHABIPERS is listed in the revised Schedule A 20 as defendant no. 144, not defendant no. 111. Similarly, MSCOCO is listed in the revised Schedule A 20 as defendant no. 9, not defendant no. 16. The plaintiff has "received filed copies" of the revised Schedule A, so possessing "slightly different" versions of the relevant documents no longer justifies the mismatch 120. Third, and perhaps most concerningly, the Court has already recognized the dismissal of defendant MSCOCO 116. The Court previously warned the plaintiff "not to re-list defendants whose dismissal the Court has already recognized" in future dismissal notices 121. It is evident that the plaintiff cannot keep track of the many defendants in this case. Accordingly, and consistent with the Court's reservation of "the right to impose the penalty in docket entry 117 as a sanction for future noncompliance," the Court dismisses all defendants except defendant nos. 6-8, 10-12, 16-17, and 23-24 (the ten lowest-numbered remaining defendants) from this suit without prejudice. For reference, those defendants are yujiekeji, Foni Shop, Ugrace Hair, Chomsi LLC, XUNY'S online, Donna Titan, JQNus-US, ShineTai, Tinashe Hair, and Star Show Hair 20. By 11/12/24, the plaintiff shall submit a new Schedule A in this case relabeling defendant nos. 6-8, 10-12, 16-17, and 23-24 as defendant nos. 1-10 (and listing only those defendants). If appropriate, the Court will recognize the dismissal of Tinashe Hair (upon renewed notice) after receiving the new Schedule A. The plaintiff may "refile new cases, with no more than ten defendants each, as to the dismissed defendants" 117. In so doing, the plaintiff must mark each new case as related to this matter so it is assigned to Judge Tharp. N.D. Ill. L.R. 40.3(b)(2). Because the TRO in this case has expired, and because the Court "may issue a preliminary injunction only on notice to adverse parties" 88, the Court will not entertain motions to seal or TRO motions (typical of newly filed Schedule A matters) in the new cases. Mailed notice |

11/06/2024 | NOTICE of Voluntary Dismissal by ZHIYONG Huang of AHABIPERS Deal LLC (#111 on Schedule A) |
10/17/2024 | MINUTE entry before the Honorable John J. Tharp, Jr:Defendant no. 2's motion to compel 128 is denied. Defendant no. 2 asks the Court to compel the plaintiff to inform Amazon that "due to the dismissal between the parties, all restraints imposed by the Court should be released." But it provides no evidence that the plaintiff is unwilling to do so, instead indicating that the plaintiff has agreed to "instruct Amazon to release [the relevant] store." In addition, it provides no evidence that it has tried to contact Amazon itself. In any event, if Amazon is not violating an order of this Court, the Court has no jurisdiction to compel Amazon to release assets in its possession or control. The parties are reminded once again 87 102 that all filings in this matter must include the "defendant number" for each defendant. |
10/16/2024 | MOTION by Defendant FeYuMM to compel Plaintiff to Inform Third Party |
10/08/2024 | MINUTE entry before the Honorable John J. Tharp, Jr: Upon receipt of the plaintiff's notice of voluntary dismissal pursuant to Fed. R. Civ. P. 41(a)(1)(A)(i) 126, defendant no. 135 is dismissed from this case. Mailed notice |
10/04/2024 | NOTICE of Voluntary Dismissal by ZHIYONG Huang of Def 135 in Schedule A |
10/04/2024 | MINUTE entry before the Honorable John J. Tharp, Jr: Upon receipt of the plaintiff's notices of voluntary dismissal pursuant to Fed. R. Civ. P. 41(a)(1)(A)(i) 122 123 124, defendant nos. 110, 125, 146, 154, 161, 171, 176, 199, 201, and 211 are dismissed from this case. Mailed notice |

10/02/2024 | NOTICE of Voluntary Dismissal by ZHIYONG Huang of Def No. 211 of Schedule A |
10/01/2024 | MINUTE entry before the Honorable John J. Tharp, Jr: The Court, having reviewed the plaintiff's show-cause response [120], declines to limit this case to ten defendants for the time being. That said, the Court instructs the plaintiff to carefully follow its directions in the future, and it reserves the right to impose the penalty in docket entry [117] as a sanction for future noncompliance. Relatedly, the Court observes that docket entry [119] it is not, as ordered, a revised version of docket entry [115] "with correct 'defendant numbers' for all listed defendants" [117]. Docket entry [115] lists four defendants, and docket entry [119] lists 32 defendants, 24 of which have already been dismissed [116]. What is more, docket entry [119] does not list YUANQUQU (defendant no. 176), which was listed in docket entry [115]. The Court trusts that this mistake, like other previous mistakes, was "inadvertent" [120]. The plaintiff is ordered, consistent with the Court's order of 9/25/24 [117], to file a true revised version of docket entry [115] by 10/3/24. Any new defendants dismissed beyond those listed in docket entry [115] should be included in a separate notice, also to be filed by 10/3/24. The plaintiff is warned, in future notices of dismissal, not to re-list defendants whose dismissal the Court has already recognized. Mailed notice |
09/30/2024 | RESPONSE by Plaintiff ZHIYONG Huang to text entry, 117 Court Order to Show Cause |
09/27/2024 | NOTICE of Voluntary Dismissal by ZHIYONG Huang Revised Notice of Voluntary Dismissal (DE 115) for Defendants Numbered 2, 9, 20, 25, 37, 38, 110, 111, 112, 115, 121, 125, 129, 131, 141, 146, 148, 151, 152, 154, 159, 161, 165, 171, 180, 190, 199, 201, 202, 203, 204, 207 |
09/27/2024 | Updated Schedule A by ZHIYONG Huang for DE 20 (Chengyifeng) |
09/25/2024 | MINUTE entry before the Honorable John J. Tharp, Jr: The Court, having reviewed docket entry [115], declines to recognize the dismissal of the listed defendants. That is because, despite the Court's prior admonishment "to ensure, in all future filings, that the names and 'defendant numbers' precisely match" [113], there are two mismatches in this filing. Agiufgs, listed in the plaintiff's filing as defendant no. 90, appears to be defendant no. 110 in the revised Schedule A [20]. Additionally, maoxi, listed in the plaintiff's filing as defendant no. 121, appears to be defendant no. 161 [20]. The plaintiff is ordered, by 9/27/24, to file a revised version of docket entry [115] with correct "defendant numbers" for all listed defendants. In view of the apparent inability of plaintiff's counsel to track the status of the defendants named in this action, the plaintiff is further ordered, by 9/30/24, to show cause why the Court should not (1) dismiss all but the ten lowest-numbered remaining defendants in this suit, and (2) provide the plaintiff leave to refile new cases, with no more than ten defendants each, as to the dismissed defendants. Mailed notice |
09/25/2024 | MINUTE entry before the Honorable John J. Tharp, Jr: Upon receipt of the plaintiff's notice of voluntary dismissal pursuant to Fed. R. Civ. P. 41(a)(1)(A)(i) [114], defendant nos. 2, 9, 20, 25, 37-38, 111-112, 115, 121, 129, 131, 141, 148, 151-152, 159, 165, 180, 190, 202-204, and 207 are dismissed from this case. The Court notes that defendant no. 20 (CHENGYIFENG) is erroneously listed as defendant no. 29 in the revised Schedule A [20], and that defendant no. 20, not defendant no. 29, has been dismissed here. Mailed notice |
09/24/2024 | NOTICE of Voluntary Dismissal by ZHIYONG Huang of the following Schedule A Defendants, Numbers 90, 121, 154, 176) |
09/23/2024 | NOTICE of Voluntary Dismissal by ZHIYONG Huang Revised for Defendants as noted on Schedule A (Numbers 2, 9, 20, 25, 37, 38, 111, 112, 115, 121, 129, 131, 141, 148, 151, 152, 159, 165, 180, 190, 202, 203, 204, 207) |
09/19/2024 | ORDER Signed by the Honorable John J. Tharp, Jr on 9/19/2024: The Court recognizes the voluntary dismissal, pursuant to Fed. R. Civ. P. 41(a)(1)(A)(i), of the defendants listed below. This order shall supersede all prior recognitions of voluntarily dismissed defendants. The Court notes that Zeefft, listed in the plaintiff's proposed order as defendant no. 134, appears to be defendant no. 177 24, and that Superior Central, listed in the plaintiff's proposed order as defendant no. 153, appears to be defendant no. 133 24. The Court has made these adjustments. If either is incorrect (the plaintiff, for example, dismissed the party listed in the revised Schedule A as defendant no. 134), the plaintiff must inform the Court by 9/23/24. The list below does not contain any of the defendants named in docket entry 112. That is because many of the "defendant numbers" in that docket entry do not match the numbers in the revised Schedule A 20 24. Eternalsun, listed as defendant no. 114, appears to be defendant no. 151 20 ; Crowdstage, listed as defendant no. 112, appears to be defendant no. 148 20 ; daoxu, listed as defendant no. 94, appears to be defendant no. 115 24 ; and so on. The plaintiff is ordered, by 9/23/24, to file a revised version of docket entry 112 with correct "defendant numbers" for all listed defendants. The plaintiff is further admonished to ensure, in all future filings, that the names and "defendant numbers" precisely match. Given prior oversights, the oversights in the proposed order, and the oversights in docket entry 112, future mismatches may result in sanctions, including dismissal of this action.Mailed notice |
09/18/2024 | NOTICE of Voluntary Dismissal by ZHIYONG Huang of multiple defendants identified in Schedule A (#s2, 9, 20, 25, 37, 38, 91, 92, 94, 109, 112, 114, 119, 121, 125, 129, 131, 143, 145, 146, 147, 152, 180, 207) |
09/17/2024 | MINUTE entry before the Honorable John J. Tharp, Jr:Defendants' motion to extend [107] is granted. The deadline to answer or otherwise respond is continued to 10/7/24 (21 days from the date of the motion's filing). The Court notes, however, that the initial deadline to answer or otherwise respond was 8/23/24, and the defendants did not move for an extension before that date. Accordingly, no further extensions will be granted for these defendants. The defendants are again reminded [87] [102] that all filings in this matter must include the "defendant number" for each defendant. Mailed notice |
09/17/2024 | MINUTE entry before the Honorable John J. Tharp, Jr:Having reviewed the plaintiff's updated dismissal list [108], the Court directs the plaintiff to submit a proposed order recognizing the dismissal of the listed defendants to this Court's proposed order inbox, Proposed_Order_Tharp@ilnd.uscourts.gov, by 9/18/24. The order shall be in Microsoft Word format; it shall not include defendants "to be dismissed" (capitalization altered); it shall include a table with each dismissed defendant; and it shall list, as previously instructed, the proper "defendant number" for each dismissed defendant [87] [102]. The Court notes that several of the defendants listed in the plaintiff's most recent dismissal notice [105] (Erichip, Lozakom, Qirkina) do not appear in the updated dismissal list; the proposed order shall address or fix this discrepancy. Failure to timely comply may again incur sanctions, including dismissal of this action. Mailed notice |
09/17/2024 | MINUTE entry before the Honorable John J. Tharp, Jr:Because the plaintiff's updated dismissal list [108] includes Chengzhuan Co., Ltd., Qiaosheng Co., Ltd., and Weidong Co., Ltd. (defendant nos. 164, 172, and 182), the motion by those defendants to dismiss for lack of personal jurisdiction [77] is denied as moot. The Court will formally recognize the dismissal of these defendants in a forthcoming order. Mailed notice |

09/13/2024 | NOTICE of Voluntary Dismissal by ZHIYONG Huang |
09/11/2024 | MINUTE entry before the Honorable John J. Tharp, Jr: By order entered on 8/27/24 [103], the Court directed Plaintiff to file a list with the Court of defendants voluntarily dismissed from this action to date. Plaintiff has failed to comply with that order. The Court will sua sponte extend the deadline to identify all dismissed defendants to 9/16/24. Failure to timely comply may incur sanctions including dismissal of this action. Mailed notice |
08/27/2024 | MINUTE entry before the Honorable John J. Tharp, Jr: The Court is in receipt of the plaintiff's notices of voluntary dismissal 91 92 93 94 95 96 97 98 99 100 101. The plaintiff is advised that, for future notices of voluntary dismissals being filed contemporaneously, one consolidated notice should be filed rather than a separate notice for each defendant. Although the Court would ordinarily recognize the dismissal of each defendant listed by the plaintiff, the Court observes two issues with this most recent round of notices. First, some defendants that the plaintiff purports to dismiss at this juncture, including South City 93, have already been dismissed 46. Second, several numbers listed in the notices do not match the numbers appearing in the revised Schedule A. Homethrive is listed as defendant no. 117, for example 100, but appears on the revised Schedule A as defendant no. 157 20. On review of previous notices of voluntary dismissal, the Court has identified the same error. The plaintiff previously dismissed "Entasser (No. 139)" 35, for example, but Entasser appears on the revised Schedule A as defendant no. 185 24. The Court recognized the dismissal of defendant no. 139 49, but this defendant does not appear to be Entasser. The plaintiff is therefore directed, by 8/30/24, to file a list with the Court of defendants voluntarily dismissed from this action to date. Each entry in the list shall include the defendant's name and its correct number in the revised Schedule A 20 24. The list shall include, as previously directed 87, the defendant(s) that the plaintiff intended to dismiss in docket entries 80 and 81. Upon receipt of the list, the Court will clarify which defendants have been dismissed from this action. Mailed notice |
08/23/2024 | MINUTE entry before the Honorable John J. Tharp, Jr:Defendants' unopposed motion to extend the deadline to answer or otherwise respond 90 is granted. An answer or other responsive pleading by the defendants listed in the motion is due 9/13/24. The parties are reminded that, as previously instructed 87, all filings in this matter must include the "defendant number" for each defendant. Mailed notice |

08/21/2024 | MINUTE entry before the Honorable John J. Tharp, Jr:The plaintiff's motion for entry of a preliminary injunction 85 86 is denied without prejudice. A court may issue a preliminary injunction only on notice to adverse parties, Fed. R. Civ. P. 65(a)(1), and here the plaintiff has not adequately attested to its notification efforts. The plaintiff declares [85-1] that "[a]ll Defendants listed in this action and provided on Schedule A have been forward a [pertinent] link," and the returned summons 84 indicates that plaintiff's counsel "obtained contact information for defendants on Schedule A" and "served defendants via email." But neither piece of information identifies the specific email addresses (corresponding to the specific defendants) served. The plaintiff is afforded leave to file a declaration of serviceexpressly identifying which defendants have received proper servicealong with a renewed motion for a preliminary injunction. The Court declines to extend the TRO, which expires today, at this juncture. In extending the TRO 30 31, the Court (1) "cautioned" the plaintiff "to read orders carefully and comply with all deadlines set by the Court," and (2) specified that a motion for a preliminary injunction "must be served at least three business days prior to the [TRO's] expiration." The plaintiff's preliminary injunction motion was not served three business days prior to the expiration of the TRO, the Court sees no reason to excuse the plaintiff's noncompliance. Mailed notice |
08/21/2024 | MINUTE entry before the Honorable John J. Tharp, Jr:Upon receipt of the plaintiff's notices of voluntary dismissal pursuant to Fed. R. Civ. P. 41(a)(1)(A)(i) 82 83, defendant nos. 164 and 182 are dismissed from this case. The Court notes that two of the plaintiff's notices 80 81 list a defendant whose number does not match the name provided for that number in the revised Schedule A 20 24. The plaintiff is directed to re-file these notices (or a single notice) with a corrected defendant name or number as appropriate. Separately, the parties are instructed to include the "defendant numbers," as identified in the revised Schedule A, when referring to any defendants in all future filings. Mailed notice |
