No appearance is required on 10/22/24. Plaintiff's written submissions establish that if defendants were informed of this proceeding before a temporary restraining order could issue, assets would likely be redirected, defeating plaintiff's interests in identifying defendants, stopping the infringement, and obtaining an accounting. In addition, the submitted evidence establishes a likelihood of success on the merits, the harm to plaintiff is irreparable, and an injunction is in the public interest because infringement interferes with the plaintiff's ability to control its intellectual property. Those rights cannot be fully compensated by money damages. There is no countervailing harm to defendants from an order directing them to stop infringement. Electronic service of process does not violate any treaty and is consistent with due process because it is an effective way to communicate with defendants. Expedited discovery is warranted to identify defendants and implement the asset freeze. If any defendant were to appear and object, the Court will take a fresh look at issues related to asset freeze, joinder, and personal jurisdiction. The court finds that security in the amount of $1,000 is sufficient to secure the injunctive relief. Enter Sealed Temporary Restraining Order. |

The amended motion for a temporary restraining order should be accompanied by the following materials: (1) Plaintiff should complete the template found on Judge Jenkins' website linked under "Schedule A" Cases and add to the template a column that includes the date Plaintiff collected the evidence of each defendant's alleged infringement; (2) Plaintiff should submit a listing of all prior Schedule A cases filed in any court in the United States in which it was a plaintiff, a listing of any of the defendants included in the Schedule A in this case that Plaintiff has previously named as a defendant in any prior complaint or Schedule A case, and a certification that Plaintiff has not used any of the screenshot evidence supplied in support of a motion for a TRO in this case in any prior proceeding; and (3) Plaintiff should submit a memorandum explaining why, based on its allegations, joinder of claims involving 10 different trademarks and 142 defendants is appropriate under FRCP 20, particularly where, based on the materials submitted by plaintiff, at least some of the defendants appear to be selling products that do not feature "signature long, turquoise ponytails." Plaintiff's amended motion for electronic service of process should Sec. & Exch. Comm'n v. Lahr, No. 22-2497, 2024 WL 3518309 (3d Cir. July 24, 2024); Duong v. DDG BIM Services, LLC, 700 F. Supp. 3d 1088 (M.D. Fla. 2023); and Smart Study Co., Ltd. v. Acuteye-Us, 620 F. Supp. 3d 1382 (S.D.N.Y. 2022). Plaintiff's memorandum should also describe what efforts it has made to discover the physical addresses of the defendants in this matter and whether expedited discovery would assist in that effort.
