12/20/2024 | ANNUAL REMINDER: Pursuant to Local Rule 3.2 (Notification of Affiliates), any nongovernmental party, other than an individual or sole proprietorship, must file a statement identifying all its affiliates known to the party after diligent review or, if the party has identified no affiliates, then a statement reflecting that fact must be filed. An affiliate is defined as follows: any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party. The statement is to be electronically filed as a PDF in conjunction with entering the affiliates in CM/ECF as prompted. As a reminder to counsel, parties must supplement their statements of affiliates within thirty (30) days of any change in the information previously reported. This minute order is being issued to all counsel of record to remind counsel of their obligation to provide updated information as to additional affiliates if such updating is necessary. 12/13/2024 | MINUTE entry before the Honorable John J. Tharp, Jr:The plaintiff's motion for a TRO 14 is denied without prejudice. In support of the complaint, the plaintiff has provided screenshot evidence of the defendants' allegedly infringing products for sale online 6 7 and a claim chart analyzing the infringement of an "exemplary infringing product" from one of the defendants [5-3]. The Court cannot determine from these that each accused product contains all of the attributes required to infringe on the asserted patent. This is not like a trademark or copyright online counterfeiting suit, where a defendant's online infringement can be readily ascertained by examining the screenshot of a webpage. The Court would never grant preliminary injunctive relief in a single-defendant patent case without a rigorous comparison between the accused product(s) and the asserted claim(s), so it should go without saying that the Court will not do so against more than 100 defendants. The plaintiff must conduct (and file) a product-by-product analysis that (1) identifies each claim of the asserted patent that is allegedly infringed by each product of each defendant, and (2) demonstrates how each accused product incorporates every limitation of the claim(s) it allegedly infringes. If multiple parties are selling exactly identical products, the product-by-product analysis must so clarify. Additionally, the plaintiff must submit a supplemental document explaining why it is entitled to an asset restraint in this suit. CSC Holdings, Inc. v. Redisi, 309 F.3d 988, 996 (7th Cir. 2002) ("[A] district court may not issue an injunction freezing assets in an action for money damages where no equitable interest is claimed."); ABC Prods. v. Schedule A, No. 23-cv-04131, 2024 WL 1549784, at *6 (N.D. Ill. Jan. 9, 2024) (suit for patent infringement "does not provide for the equitable relief of accounting and profits"); see Univ. of Colo. Found., Inc. v. Am. Cyanamid Co., 342 F.3d 1298, 1306 (Fed. Cir. 2003) (unjust-enrichment claims preempted when sufficiently "patent-like"). Mailed notice |
