01/15/2025 | MINUTE entry before the Honorable Sharon Johnson Coleman: After having reviewed the revised proposed order that Plaintiff submitted, the Court denies Plaintiff's motion for leave to file certain documents under seal 3, ex parte motion for entry of a temporary restraining order, including a temporary injunction, a temporary asset restraint, and expedited discovery 16, and motion for electronic service of process pursuant to Fed. R. Civ. P. 4(f)(3) 20. The Court finds that Plaintiff's proposed order is, once again, not sufficiently tailored to Plaintiff's requested relief and representation to the Court. Specifically, during presentment of its motions on January 14, 2025, Plaintiff's counsel stated that "one defendant has one product that we found infringing," further explaining that the single product consisted of "a Murder Drones doll." The Court will not grant a request for an injunction that is broader than necessary in scope, see, e.g., Am. Can Co. v. Mansukhani, 742, F.2d 314, 321 (7th Cir. 1984), and will likewise not guide Plaintiff in how to prosecute its case. In-person status hearing set for 1/28/2025 at 10:00 AM to stand. Mailed notice. |

R. Civ. P. 4(f)(3) [20] are granted. The Court reviewed the proposed order submitted by counsel. Counsel is to submit a revised proposed order that is sufficiently tailored to plaintiff's motion, the trademark and/or copyright allegedly being infringed, and the single product use. An in-person status hearing is set for 1/28/2025 at 10:00 AM. Mailed notice. |
