01/10/2025 MINUTE entry before the Honorable Matthew F. Kennelly: Telephonic status hearing held on 1/10/2025. The Clerk is directed to change the caption and title of the case to say: Maple and Lark LLC v. The Partnerships. The plaintiff's motion for temporary restraining order 6 is granted. The case is set for a preliminary injunction hearing on 1/24/2025 at 9:00 a.m. The following call-in number will be used for the hearing: 650-479-3207; access code 2305-915-8729. Any motion to extend the TRO or for preliminary injunction is due 1/21/2025. Any motion for preliminary injunction filed in this case must be accompanied by a certificate stating upon whom and how the motion has been served. In addition, plaintiff must promptly serve defendants with process and should not wait until too close to the hearing to do so; if plaintiff delays too long the Court may deny entry of a preliminary injunction due to inadequate notice of the lawsuit. Persons granted remote access to proceedings are reminded of the general prohibition against photographing, recording, and rebroadcasting of court proceedings. Violation of these prohibitions may result in sanctions, including removal of court issued media credentials, restricted entry to future hearings, denial of entry to future hearings, or any other sanctions deemed necessary by the Court. 12/20/2024 ANNUAL REMINDER: Pursuant to Local Rule 3.2 (Notification of Affiliates), any nongovernmental party, other than an individual or sole proprietorship, must file a statement identifying all its affiliates known to the party after diligent review or, if the party has identified no affiliates, then a statement reflecting that fact must be filed. An affiliate is defined as follows: any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party. The statement is to be electronically filed as a PDF in conjunction with entering the affiliates in CM/ECF as prompted. As a reminder to counsel, parties must supplement their statements of affiliates within thirty (30) days of any change in the information previously reported. This minute order is being issued to all counsel of record to remind counsel of their obligation to provide updated information as to additional affiliates if such updating is necessary. 12/11/2024 MINUTE entry before the Honorable Matthew F. Kennelly: Plaintiff has filed a revised "Schedule A" that lists 445 defendants in this case. In the Court's view, inclusion of that many defendants in a single suit stretches Rule 20(a) beyond appropriate and reasonable limits. The Court will discuss the case based on Rule 20(a) unless plaintiff reduces the number of defendants in this case to no more than 250. Plaintiff may, of course, include the defendants dropped from this case in a separate complaint, which the Court represents that it will accept as a related case upon the filing of a proper motion under Local Rule 40.4 if plaintiff chooses to file such a motion.

12/10/2024 MINUTE entry before the Honorable Matthew F. Kennelly: The plaintiff in this case has filed suit under a pseudonym against a large number of defendants, seeking damages and an injunction for alleged copyright infringement. There are at least two preliminary deficiencies that preclude the Court at this point from granting any of the relief sought by plaintiff. First, though plaintiff has adequately justified naming the defendants under seal temporarily, in the Court's view plaintiff has not adequately justified suing under a pseudonym. This District handles a large number of cases of this type, apparently indistinguishable from this one except for the particular plaintiff and products, and it is quite rare in this judge's experience for litigants to even ask to litigate as a "John Doe," let alone be given leave to do so. More is required to justify this than what plaintiff has thus far submitted. Second, given the way plaintiff prepared its "Schedule A" to the complaint and draft TRO, using a separate line item for each product and defendant, the Court cannot determine how many defendants plaintiff has sued and thus whether the number of defendants exceeds reasonable limits. The pending motions 6 10 12 are all denied without prejudice until these issues are resolved. The ball is now in plaintiff's court.
