Valderrama: For the reasons stated in the motions, the Court grants Plaintiff's ex parte motion for a temporary restraining order, including a temporary asset restraint, and expedited discovery 8, motion for electronic service of process pursuant to Fed. R. Civ. P. 4(f)(3) 12, and motion for leave to file under seal 16. Enter Sealed Temporary Restraining Order as amended. Provided that Plaintiff provides the security described in paragraph 11 of the temporary restraining order, the temporary restraining order shall become effective on 09/23/2024 at 6:00 p.m. and shall expire in fourteen (14) days from the effective date. The Court finds that joinder of the "Schedule A" Defendants is proper at this preliminary stage. Fed. R. Civ. P. 20(a)(2)(A). The Court notes that no Defendants are prejudiced by permitting joinder at this juncture. See Bose Corp. v. Partnerships & Unincorporated Associations Identified on Schedule "A", 334 F.R.D. 511, 517 (N.D. Ill. 2020). 09/09/2024 | MINUTE entry before the Honorable Franklin U. Valderrama: This case has been reassigned to this Court 13. Plaintiff has filed this case using a pseudonym. As an initial matter, in order to proceed under a pseudonym, a party should file a motion to do so, rather than simply state it is doing so via a footnote in the complaint. Additionally, Plaintiff has filed a number of documents under seal but has not filed a motion for leave to file under seal as required under Local Rule 26.2(c). As to proceeding via pseudonym, the Seventh Circuit has "repeatedly voiced [its] disfavor of parties proceeding anonymously, as anonymous litigation runs contrary to the rights of the public to have open judicial proceedings and to know who is using court facilities and procedures funded by public taxes. To proceed anonymously, a party must demonstrate 'exceptional circumstances' that outweigh both the public policy in favor of identified parties and the prejudice to the opposing party that would result from anonymity." Doe v. Vill. of Deerfield, 819 F.3d 372, 37677 (7th Cir. 2016) (citation omitted); see also Doe v. Smith, 429 F.3d 706, 710 (7th Cir. 2005) ("[T]his circuit's decisions. disfavor anonymous litigation."); Doe v. Blue Cross & Blue Shield United of Wis., 112 F.3d 869, 872 (7th Cir. 1997) ("Identifying the parties to the proceeding is an important dimension of publicness. The people have a right to know who is using their courts."). Absent a motion, the Court cannot see how this Schedule A plaintiff meets the "exceptional circumstances" requirement as outlined by the Seventh Circuit. Even so, "[t]o permit pseudonymity/anonymity here, while many other Schedule A plaintiffs proceed under their actual names, would threaten to allow the exception of 'exceptional circumstances' to swallow the general rule barring pseudonymity." XYZ Corp. v. Partnerships & Unincorporated Associations Identified on Schedule A,2022 WL 180151, at *2 (N.D. Ill. Jan. 20, 2022). The Court therefore instructs Plaintiff, by 9/13/2024 to: either file a motion for leave to proceed via pseudonym, bearing in mind the strict standard above, or file an file an amended complaint that lists Plaintiff's true name. Plaintiff must also file a motion for leave to file under seal by 9/13/2024 in order to maintain under seal the documents filed under seal. Mailed notice. |
