11/21/2024 | Consent Judgment and Permanent Injunction Signed by the Honorable Joan B. Gottschall on 11/21/2024.Mailed notice |
11/05/2024 | MINUTE entry before the Honorable Joan B. Gottschall: The parties' joint motion [43] for entry of their agreed consent judgment is granted. However, the following three revisions must be made to the proposed consent judgment emailed to the court on 11/01/2024. First, the singular word "defendant" must be replaced with "defendants" as appropriate. Second, to make clear who is bound by the judgment, the caption must be revised, or a schedule of defendants must be attached. Finally, page two of the proposed consent judgment states that the parties' settlement agreement is attached as exhibit A and incorporated by reference. Exhibit A must therefore be attached to the revised proposed consent judgment. Counsel are instructed to resubmit their proposed consent judgment to Proposed_Order_Gottschall@ilnd.uscourts.gov on or before 11/13/2024. Mailed notice |
11/01/2024 | MOTION by Plaintiff George & Company LLC to approve consent judgment re: Defs. 1-4, 9-11 |
10/02/2024 | ORDER: An initial status report is due on or before November 1, 2024. Counsel and parties are directed to familiarize themselves with the pretrial procedures in Judge Gottschall's case management packet, which is available from the court's website at http://www.ilnd.uscourts.gov. Please pay particular attention to the requirement to exchange initial disclosures within 14 days of the parties' initial discovery planning conference and the court's requirement that the parties are to explore settlement opportunities and identify areas of agreement prior to the filing of the first status report. See Fed. R. Civ. P. 26(a)(1)(C) and 26(f)(2). If, by the due date of the scheduled status report, defendants have not been served, plaintiff should send an email to the chambers email account, chambers_gottschall@ilnd.uscourts.gov, to reset the status date. Counsel in cases removed from another court should follow these procedures to the extent applicable. See the order and Judge Gottschall's case management packet for further details. Signed by the Honorable Joan B. Gottschall on 10/2/2024. Mailed notice |
10/02/2024 | MINUTE entry before the Honorable Joan B. Gottschall: Plaintiff represents [40] that it is in settlement discussions with defendants and that it "would not oppose unsealing the currently-sealed material in the case's docket." Accordingly, the Clerk is directed to unseal all presently sealed documents in this case. Mailed notice |
09/30/2024 | STATUS Report re: seal by George & Company LLC |
09/20/2024 | MINUTE entry before the Honorable Joan B. Gottschall: In lieu of filing a motion for preliminary injunction, plaintiff renewed its motion for leave to serve the summons and complaint by electronic means. No defendant has appeared, and no request for a hearing has been received. Accordingly, the preliminary injunction hearing tentatively set for this date (09/20/2024) is stricken. Plaintiff has ten days, to and including September 30, 2024, to inform the court of whether the seal currently in place should continue, and if so, why.Mailed notice |
09/20/2024 | MINUTE entry before the Honorable Joan B. Gottschall: To show reasonable diligence identifying defendants' mailing addresses, plaintiff's attorney avers that he translated Chinese-language addresses on defendants' Amazon seller pages and searched for the resulting addresses on Google Maps. Decl. of A. Urbanczyk ¶ 4, ECF No. 37. The results of counsel's searches indicate that the translated addresses may be incomplete; many addresses refer to disparate regions of China or an entire block. See id. ¶¶ 5-11, see also id. Ex. 1. On this record, it is not clear whether defendants' addresses are unknown or whether they cannot be determined using Google translate. Accordingly, plaintiff's motion [36] for leave to serve process by electronic means is denied without prejudice. If plaintiff renews its motion, it must use a more reliable means of translating the addresses on defendants' Amazon sellers. See ABC Corp. v. Defs. Listed on Sched. A 2022 WL 18937941, at *1-2 (N.D. Ill. Dec. 19, 2022).Mailed notice |

The preliminary injunction hearing tentatively set for 9/6/2024 at 10:30 a.m. is stricken and reset to 9/20/2024 at 10:30 a.m. The court will rule on any preliminary injunction motion without holding a hearing unless a hearing is requested at least 48 hours before the time of the scheduled hearing. 08/12/2024 | CERTIFICATE of Service by Adam Edward Urbanczyk on behalf of George & Company LLC regarding order on motion to supplement, set motion and R&R deadlines/hearings, [29] 附件: 1:Exhibit 1 |
08/12/2024 | MINUTE entry before the Honorable Joan B. Gottschall: Upon consideration of plaintiff's memorandum [28] regarding joinder, the court finds, in the absence of adversary presentation, that the seven defendants are properly joined for the reasons given in the minute order [20] of 7/12/2024. Plaintiff's motion [25] to supplement its renewed motion for a temporary restraining order is granted. Although plaintiff gave notice [24] of its motion for temporary restraining order to non-party Amazon.com ("Amazon"), no response deadline has been set, so the court cannot determine whether Amazon opposes plaintiff's proposed finding that it would be bound by the proposed temporary restraining order under Federal Rule of Civil Procedure 65(d)(2). Accordingly, Amazon is given until and including 8/13/2024 to file a response to, or request a hearing on, plaintiff's renewed motion [23] for a temporary restraining order. Any hearing will be held by teleconference. A hearing may be requested by sending a message copying all counsel of record to Chambers_Gottschall@ilnd.uscourts.gov. Plaintiff is instructed to serve Amazon with a copy of this order and file a supplemental certificate of service by and including 8/13/2024. Mailed notice |

07/25/2024 | CERTIFICATE of Service by Plaintiff George & Company LLC regarding exhibit[13], exhibit[14], amended complaint[12], MOTION by Plaintiff George & Company LLC for temporary restraining order, RENEWED [23] 附件: 1:Exhibit 1 |

07/12/2024 | MINUTE entry before the Honorable Joan B. Gottschall: Plaintiff's ex parte motion [5] for temporary restraining order is denied without prejudice for failure to comply with this court's standing order in Lanham Act counterfeiting cases ("standing order"), available from Judge Gottschall's page on the court's website at https://www.ilnd.uscourts.gov/. The standing provides in full: "Counsel should be aware that pursuant to Seventh Circuit authority, under Fed. R. Civ. P. 65(d)(2), third parties not named in the complaint (typically, for example, Amazon and eBay) cannot be named as in active concert or participation with the defendants unless their active concert or participation is proven AND they receive advance notice and an opportunity to be heard before any such order is entered. Any proposed order not complying with the cases identified here will be rejected. Please see the following cases: Lake Shore Asset Management Limited v. Commodity Futures Trading Commission, 511 F.3d 762 (7th Cir. 2007); United States v. Kirschenbaum, 156 F.3d 784 (7th Cir. 1998); Pow! Entertainment, LLC v. Individuals, Corporations, Limited Liability Companies, Partnerships, and Unincorporated Associations Identified On Schedule A Hereto, 2020 WL 5076715 (N.D. Ill. Aug. 26, 2020)." In its motion [5] and supporting memorandum [5-1] of law, plaintiff does not discuss or attempt to distinguish the authorities cited in this court's standing order. Plaintiff may renew its motion for temporary restraining order on or before 7/25/2024. Unless plaintiff argues that notice is not required, Any renewed motion must be accompanied by a certificate of service upon the third-party service providers named in plaintiff's proposed temporary restraining order. Mailed notice. |
07/12/2024 | MINUTE entry before the Honorable Joan B. Gottschall: Plaintiff's motion [7] under Fed. R. Civ. P. 4(f)(3) for leave to serve the summons and complaint by electronic means is denied as premature. Plaintiff neither cites nor attempts to distinguish this court's decision in Luxottica Grp. S.p.A. v. Partnerships & Unincorporated Associations Identified on Schedule "A", 391 F. Supp. 3d 816, 821-28 (N.D. Ill. 2019), holding that a plaintiff must demonstrate a reasonably diligent inquiry in attempting to identify defendant's mailing address before the court can conclude that the Hague Convention does not apply. Nothing in the record indicates that plaintiff has conducted such an inquiry. See id. at 820-21. Plaintiff may renew its motion for electronic service of process once third parties have produced discovery, and plaintiff has conducted a reasonably diligent inquiry into any mailing addresses produced in discovery that are associated with defendants. Mailed notice. |
07/12/2024 | MINUTE entry before the Honorable Joan B. Gottschall: Upon consideration of plaintiff's memorandum of law [15] in support of joinder and plaintiff's supplemental exhibits (Doc. Nos. [18], [19]), the court determines in the absence of adversary presentation that plaintiff has adequately demonstrated that joinder of the 11 defendants named in its amended complaint is proper under Federal Rule of Civil Procedure 20(a)(2). The court will therefore proceed to plaintiff's pending motions. Mailed notice. |
07/01/2024 | MINUTE entry before the Honorable Joan B. Gottschall: Plaintiff's supplement [17] to its memorandum regarding joinder has been inadvertently docketed as a motion. The Clerk is directed to update the docket text and terminate plaintiff's supplement [17] as a pending motion. Plaintiff's joinder memorandum and the supplemental material filed 6/28/2024 are taken under advisement.Mailed notice |

06/21/2024 | MINUTE entry before the Honorable Joan B. Gottschall: On pages 2-4 of its memorandum of law regarding joinder of defendants [15,] plaintiff argues that all defendant stores have the same misspelling and grammar mistakes in the accused product's title, that all defendants use identical text to describe the accused products, and that all product images are identical or substantially similar. Plaintiff provides no citations and does not indicate what photographs it believes are similar. Plaintiff is instructed to supplement its memorandum of law with two charts. The first must set forth the product titles and text alleged to be similar or identical with a citation to the page of the record on which each title and description can be found. The second chart must show the product images alleged to be identical or substantially similar. This chart must cite the page of the record on which each image can be found.
